                               BY LOCAL GOVERNMENT COMMITTEE

  1                                        AN ACT
  2    RELATING TO VERIFICATION OF PLATS; AMENDING SECTION 50-1305,  IDAHO  CODE,  TO
  3        REQUIRE  THE  ENTITY  OF  JURISDICTION  THAT APPROVES THE PLAT, IF NOT THE
  4        COUNTY, TO VERIFY THE PLAT AND TO COLLECT A FEE FROM THE SUBDIVIDER.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  That Section 50-1305, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:

  8        50-1305.  VERIFICATION.  The  county,  or  the entity of jurisdiction that
  9    approves the plat if not the county, shall choose and require an Idaho profes-
 10    sional land surveyor to check the plat and computations thereon  to  determine
 11    that  the  requirements  herein  are  met, and said professional land surveyor
 12    shall certify such compliance  on  the  plat.  Such  certification  shall  not
 13    relieve the professional land surveyor who prepared the plat from responsibil-
 14    ity  for  the  plat.  For performing such service the county, or the entity of
 15    jurisdiction that approves the plat if not the county, shall collect from  the
 16    subdivider a fee as provided by local ordinance reasonably related to the cost
 17    of providing such service.

The proposed legislation provides for the revision of Section 50-1305
 Idaho Code, to require the entity of Jurisdiction who approves the 
survey plat, if not the County, to hire the examining surveyor and 
collect the Fee for verification of the plat from the subdivider.
