]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 638 BY EDUCATION COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO OPPORTUNITY SCHOLARSHIP; AMENDING SECTION 33-5604, IDAHO 3 CODE, TO REVISE THE DEFINITION OF "ELIGIBLE IDAHO POSTSECONDARY EDUCA- 4 TIONAL INSTITUTION." 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 33-5604, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 33-5604. DEFINITIONS. As used in this chapter: 9 (1) "Educational costs" means the dollar amount determined annually by 10 the state board of education as necessary for student tuition, fees, room and 11 board, books and such other expenses reasonably related to attendance at an 12 eligible Idaho postsecondary educational institution. 13 (2) "Eligible Idaho postsecondary educational institution" means: 14 (a) A public postsecondary organization governed or supervised by the 15 state board, the board of regents of the university of Idaho, a board of 16 trustees of a community college established pursuant to the provisions of 17 chapter 21, title 33, Idaho Code, or the state board for professional- 18 technical education; or 19 (b) Any educational organization located in Idaho which is: 20 (i) Operated privately; 21 (ii)Classified as not-for-profit under the Idaho Code;22(iii)Under the control of an independent board and not directly con- 23 trolled or administered by a public or political subdivision; and 24 (ivii) Accredited by an organization recognized by the state board, 25 as provided in section 33-2402, Idaho Code. 26 (3) "Eligible student" means a student who: 27 (a) Is an Idaho resident; 28 (b) Has or will graduate from an accredited high school or equivalent in 29 Idaho as determined by the state board; 30 (c) Has enrolled or applied as a full-time student to an eligible Idaho 31 postsecondary educational institution; and 32 (d) Is pursuing an undergraduate degree, certificate or diploma. 33 (4) "Financial eligibility" means the extent of a person's inability to 34 meet the educational costs associated with attending an eligible Idaho post- 35 secondary educational institution through a model of shared responsibility, 36 taking into account the required and expected contributions of such person's 37 parents, family and personal resources. 38 (5) "Opportunity scholarship program" means the scholarship program 39 described in this chapter and in the rules established by the state board. 40 (6) "State board" means the state board of education.
STATEMENT OF PURPOSE RS 18067 This legislation changes the definition of "eligible Idaho post secondary educational institution" in Idaho Code 33-5604 to allow students to use the Opportunity Scholarship at Idaho public, private not-for-profit and private for-profit institutions.
