                                BY APPROPRIATIONS COMMITTEE

  1                                        AN ACT
  2    APPROPRIATING ADDITIONAL MONEYS TO THE OFFICE OF THE GOVERNOR FOR  THE  OFFICE
  3        OF ENERGY RESOURCES FOR FISCAL YEAR 2009.

  4    Be It Enacted by the Legislature of the State of Idaho:

  5        SECTION  1.  In  addition  to  the appropriation made in Section 1, Senate
  6    Bill 1480, as enacted by the Second Regular Session of the  Fifty-ninth  Idaho
  7    Legislature,  there  is  hereby appropriated to the Office of the Governor for
  8    the Office of Energy Resources the following amount to be  expended  from  the
  9    listed funds for the period July 1, 2008, through June 30, 2009:

Statement of Purpose / Fiscal Impact


                  STATEMENT OF PURPOSE

                        RS 18145


This is a trailer appropriation bill to the Office of the Governor for the Office of Energy Resources in the amount of $407,600 of which $400,000 is from the Renewable Energy Resources Fund and $7,600 is from the Petroleum Price Violation Fund.

Last fall the Department of Interior sent Idaho moneys received from two geothermal leases. Four parcels are located in the Raft River area of Cassia County and one parcel is located near Crane Creek in Washington County. The treasurer deposited the money, paid the counties their 10% share and held the remaining $2,577,023 in a suspense account. H432 amended the distribution of royalties paid on federal lands and deposited the money to a newly created “Renewable Energy Resources Fund” effective July 1, 2008.

The frequency of future renewable leases on federal land is uncertain. Although the fund retains its interest, this funding source could be limited and should be viewed as one-time.

The appropriation also includes $7,600 from the Petroleum Price Violation Fund to correct an error the analyst made in calculating the benefit costs for FY 2009. FISCAL IMPACT

FY 2009 Appropriation from the new dedicated fund:

$25,000 ongoing to reclassify existing position to fiscal officer

$35,000 ongoing for outside legal costs

$100,000 one-time to support the 25% renewable by 2025 Council

$240,000 one-time for moving costs to move employees, telephone, equipment, furnishings to a centralized location

(The budget request had also considered spending authority of $100,000 for a low interest loan program but no spending authority is necessary for loan programs. They don’t hit the appropriation file.)

$400,000 Total from the Renewable Energy Resources Fund

Also, $7,600 is appropriated from the Petroleum Price Violation Fund to correct an error the analyst made when calculating the changes in employer benefit costs for the FY 2009 budget.

The total fiscal impact is $407,600 in dedicated funds.
