]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE HOUSE OF REPRESENTATIVES HOUSE CONCURRENT RESOLUTION NO. 37 BY RESOURCES AND CONSERVATION COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND REJECTING PENDING RULES OF THE DEPART- 3 MENT OF PARKS AND RECREATION PERTAINING TO IDAHO SAFE BOATING RULES. 4 Be It Resolved by the Legislature of the State of Idaho: 5 WHEREAS, the Legislature is vested with authority to reject executive 6 agency rules under the provisions of Section 67-5291, Idaho Code, in the event 7 that the Legislature finds that the rules are not consistent with legislative 8 intent; and 9 WHEREAS, it is the finding of the Legislature that certain rules of the 10 Department of Parks and Recreation pertaining to Idaho Safe Boating Rules are 11 not consistent with legislative intent and should be rejected. 12 NOW, THEREFORE, BE IT RESOLVED by the members of the Second Regular Ses- 13 sion of the Fifty-ninth Idaho Legislature, the House of Representatives and 14 the Senate concurring therein, that IDAPA 26.01.30, Rules of the Department of 15 Parks and Recreation, Idaho Safe Boating Rules, adopted as pending rules under 16 Docket Number 26-0130-0701, the entire rulemaking docket, be, and the same is 17 hereby rejected and declared null, void and of no force and effect.
STATEMENT OF PURPOSE RS17771 This Concurrent Resolution would reject a pending rule of the Department of Parks and Recreation pertaining to the Idaho Safe Boating Rules. The effect of this Resolution, if adopted by both houses, would be to prevent the agency rule from going into effect. FISCAL NOTE This Concurrent Resolution has no fiscal impact. Contact: Rep.
