                                    SENATE BILL NO. 1289

  1                                        AN ACT
  2    RELATING TO NUCLEAR ENERGY; AMENDING SECTION 39-3027, IDAHO CODE,  TO  PROVIDE
  3        THAT  NO LAW SHALL BE ENACTED OR ACTION TAKEN BY THE STATE OF IDAHO OR ANY
  4        OF ITS POLITICAL SUBDIVISIONS TO PERMIT OR  PROHIBIT THE  USE  OF  NUCLEAR
  5        ENERGY  FOR  THE  GENERATION  OF  ELECTRICITY, UNLESS THE PROPOSED MEASURE
  6        SHALL HAVE FIRST BEEN SUBMITTED TO THE ELECTORATE  AT  THE  NEXT  EARLIEST
  7        GENERAL ELECTION.

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION  1.  That  Section 39-3027, Idaho Code, be, and the same is hereby
 10    amended to read as follows:

 11        39-3027.  LAW PERMITTING OR  PROHIBITING USE OF NUCLEAR ENERGY FOR GENERA-
 12    TION OF ELECTRICITY NEITHER PERMITTED NOR PROHIBITED UNLESS SUBMITTED TO ELEC-
 13    TORATE. No law shall be enacted or action taken by the State of Idaho  or  any
 14    of its political subdivisions to permit or  prohibit the use of nuclear energy
 15    for  the  generation  of  electricity,  unless the proposed measure shall have
 16    first been submitted to the electorate at the next earliest general  election.
 17    The  results  of  such  submission  of the question to the electorate shall be
 18    advisory in nature, and shall not prevent the legislature from acting  in  any
 19    manner on the measure.

Statement of Purpose / Fiscal Impact

                       STATEMENT OF PURPOSE

                             RS 17607

This measure would amend Idaho Code Section 39-3027 by requiring
an affirmative vote by the people of Idaho when a nuclear
facility is proposed to be constructed in Idaho.  The vote would
be advisory in nature and not binding.


                           FISCAL NOTE

No impact to the General Fund.
