                                    SENATE BILL NO. 1298

  1                                        AN ACT
  2    RELATING TO MINUTES OF GOVERNMENTAL MEETINGS; AMENDING SECTION 67-2344,  IDAHO
  3        CODE,  TO  PROVIDE  THAT  A  FULL  TRANSCRIPT OF A MEETING IS NOT REQUIRED
  4        EXCEPT AS OTHERWISE PROVIDED BY LAW,  TO PROVIDE THAT A RECORDING  OF  THE
  5        MEETING  IS REQUIRED, TO PROVIDE THAT ALL RECORDINGS SHALL BE RETAINED FOR
  6        A MINIMUM OF THREE YEARS FROM THE DATE OF THE  MEETING,  TO  PROVIDE  THAT
  7        SUCH  RECORDINGS  SHALL  BE DEEMED A PUBLIC RECORD AND TO MAKE A TECHNICAL
  8        CORRECTION.

  9    Be It Enacted by the Legislature of the State of Idaho:

 10        SECTION 1.  That Section 67-2344, Idaho Code, be, and the same  is  hereby
 11    amended to read as follows:

 12        67-2344.  WRITTEN  MINUTES OF MEETINGS. (1) The governing body of a public
 13    agency shall provide for the taking of written minutes of  all  its  meetings.
 14    Neither  a  A  full transcript nor a recording of the meeting is not required,
 15    except as otherwise provided by law. A recording of the  meeting  is  required
 16    and all recordings shall be retained for a minimum of three (3) years from the
 17    date  of the meeting. Such recordings shall be deemed a public record pursuant
 18    to chapter 3, title 9, Idaho Code. All minutes shall be available to the  pub-
 19    lic within a reasonable time after the meeting, and shall include at least the
 20    following information:
 21        (a)  All members of the governing body present;
 22        (b)  All  motions,  resolutions,  orders, or ordinances proposed and their
 23        disposition;
 24        (c)  The results of all votes, and upon the request of a member, the  vote
 25        of each member, by name.
 26        (2)  Minutes  of  executive sessions shall be limited to a specific refer-
 27    ence to the statutory subsection authorizing the executive session and  suffi-
 28    cient detail to convey the general subject matter but shall not contain infor-
 29    mation sufficient to compromise the purpose of going into executive session.

                       STATEMENT OF PURPOSE

                             RS 17531

The purpose of this legislation to amend 67-2344, Idaho Code, to
provide that recordings be required of meetings of public
agencies and that the recordings be retained for three years. 
Defines the recordings as public records. 


                           FISCAL NOTE

Since most agencies already record public meetings, there
will be some small cost associated with retaining the recordings
for three years.
