                                    SENATE BILL NO. 1317

                              BY JUDICIARY AND RULES COMMITTEE

  1                                        AN ACT
  2    RELATING TO PAROLE; AMENDING CHAPTER 2, TITLE 20, IDAHO CODE, BY THE  ADDITION
  3        OF  A  NEW  SECTION  20-239A,  IDAHO CODE, TO PROVIDE FOR RELEASE DATES OF
  4        PAROLEES WITH PAROLE ELIGIBILITY DATES THAT FALL ON A SATURDAY, SUNDAY  OR
  5        LEGAL HOLIDAY.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  That  Chapter  2,  Title  20, Idaho Code, be, and the same is
  8    hereby amended by the addition thereto of a NEW SECTION, to be known and  des-
  9    ignated as Section 20-239A, Idaho Code, and to read as follows:

 10        20-239A.  RELEASE  UPON  GRANT  OF PAROLE. Any convicted person undergoing
 11    sentence in the penitentiary who has a parole eligibility date which falls  on
 12    a  Saturday,  Sunday  or legal holiday may be granted a parole release date by
 13    the Idaho commission for pardons and parole which falls on  the  last  weekday
 14    immediately preceding such Saturday, Sunday or legal holiday.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17319

The purpose of this proposed new statute is to allow the Commission
of Pardons and Parole to release offenders onto parole on the last
business day prior to their parole eligibility date, when that date
falls on a Saturday, Sunday or legal holiday.   Idaho Code  20-239
was amended last year to include a similar provision for offenders
who have satisfied their full sentence.   The purpose of this
year's proposal is to allow Commission staff and IDOC Record staff,
who do not typically work on weekends or holidays,  to verify that
all releases of offenders from custody are proper.  This will help
ensure that offenders are released in a timely manner, and that
offenders who should be released are released.


                           FISCAL NOTE

The fiscal impact is a slight reduction in incarceration cost as
affected offenders would be paroled an additional day or two early.
