                              BY JUDICIARY AND RULES COMMITTEE

  1                                        AN ACT
  2    RELATING TO POWERS AND DUTIES OF  BOARDS  OF  TRUSTEES  OF  SCHOOL  DISTRICTS;
  3        AMENDING  SECTION  33-520,  IDAHO  CODE,  TO  PROVIDE THAT SCHOOL DISTRICT
  4        BOARDS OF TRUSTEES SHALL ADOPT POLICIES PERMITTING THE SELF-ADMINISTRATION
  5        OF MEDICATION, ADMINISTERED BY WAY OF  AN  EPINEPHRINE  AUTO-INJECTOR,  BY
  6        PUPILS.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION  1.  That  Section  33-520, Idaho Code, be, and the same is hereby
  9    amended to read as follows:

 10        33-520.  POLICY GOVERNING MEDICAL INHALERS OR EPINEPHRINE  AUTO-INJECTORS.
 11    (1)  The  board  of  trustees  of each school district, including charter dis-
 12    tricts, shall adopt a policy by  September  1,  20048,  permitting  the  self-
 13    administration  of medication administered by way of a metered-dose inhaler by
 14    a pupil for asthma or other potentially life-threatening  respiratory  illness
 15    or  by  way  of  an  epinephrine  auto-injector  for  severe allergic reaction
 16    (anaphylaxis).
 17        (2)  As used in this section:
 18        (a)  "Medication"  means  an  epinephrine  auto-injector,  a  metered-dose
 19        inhaler or a dry powder inhaler  to  alleviate  asthmatic  symptoms,  pre-
 20        scribed by a physician and having an individual label; and
 21        (b)  "Self-administration" means a student's use of medication pursuant to
 22        prescription or written direction from a physician.
 23        (3)  A  student who is permitted to self-administer asthma medication pur-
 24    suant to this section shall be permitted  to  possess  and  use  a  prescribed
 25    inhaler or epinephrine auto-injector  at all times.
 26        (4)  Nothing  in  this section shall be construed to prevent a school dis-
 27    trict  from  requiring  pupils  to  maintain  current  duplicate  prescription
 28    medications with the school nurse or, in the absence of such nurse,  with  the
 29    school administrator.

                       STATEMENT OF PURPOSE

This legislation amends Section 33-520 of Idaho Code to allow for
the self-administration and possession of an epinephrin Auto-
Injector by K-12 students. Both the possession of an epinephrin
Auto-Injector and the ability to self-administer are limited to
prescribed medication that alleviates severe allergic reactions.
The legislation maintains the authority of school districts to
require the registration of medication through school
administrative procedures.
