                                    SENATE BILL NO. 1471

  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE AGRICULTURAL RESEARCH AND  COOPERATIVE  EXTENSION
  3        SERVICE  PROGRAM  FOR FISCAL YEAR 2009; REAPPROPRIATING ANY UNEXPENDED AND
  4        UNENCUMBERED FUND BALANCES; AND SETTING FORTH THE CONDITIONS FOR  REAPPRO-
  5        PRIATION.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  There  is  hereby appropriated to the Board of Regents of the
  8    University of Idaho for the Agricultural Research  and  Cooperative  Extension
  9    Service  Program  the  following  amounts from the listed funds for the period
 10    July 1, 2008, through June 30, 2009:
 11    FROM:

 13    Equine Education Fund                                                   50,000
 14      TOTAL                                                            $28,299,200

 15        SECTION 2.  There is hereby reappropriated to the Board of Regents for the
 16    University of Idaho for the Agricultural Research  and  Cooperative  Extension
 17    Service,  subject  to  the provisions of Section 3 of this act, the unexpended
 18    and unencumbered balance of any appropriation contained in Section 1,  Chapter
 19    209,  Laws  of  2007, to be used for nonrecurring expenditures, for the period
 20    July 1, 2008, through June 30, 2009.

 21        SECTION 3.  The reappropriation for the General  Fund  moneys  granted  in
 22    Section 2 of this act shall be subject to the following provisions:
 23        (1)  If  the  unexpended  and  unencumbered balance in the General Fund on
 24    June 30, 2008, is zero, the reappropriation for the  General  Fund  moneys  in
 25    Section 2 is hereby declared to be null and void.
 26        (2)  If  the  unexpended  and  unencumbered balance in the General Fund on
 27    June 30, 2008, is greater than zero but less than the total General  Fund  re-
 28    appropriation authority granted to all state agencies, that amount reappropri-
 29    ated in Section 2 of this act shall be in the proportion that the reappropria-
 30    tion for the Board of Regents for the University of Idaho for the Agricultural
 31    Research and Cooperative Extension Service bears to the total General Fund re-
 32    appropriation authority granted to all state agencies.
