  1                                        AN ACT
  2    RELATING TO DOGS; AMENDING CHAPTER 28, TITLE 25, IDAHO CODE, BY  THE  ADDITION
  3        OF  A NEW SECTION 25-2809, IDAHO CODE, TO PROVIDE THAT THE BREEDING, RAIS-
  4        ING, BOARDING, PRODUCING OR MARKETING OF DOGS OF THE HERDING, WORKING  AND
  5        SPORTING  BREEDS  BY  THE PRODUCER SHALL BE DEEMED AN AGRICULTURAL PURSUIT
  6        AND SUCH ANIMALS SHALL BE DEEMED LIVESTOCK; AND DECLARING AN EMERGENCY.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION 1.  That Chapter 28, Title 25, Idaho Code, be,  and  the  same  is
  9    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 10    ignated as Section 25-2809, Idaho Code, and to read as follows:

 11        25-2809.  CERTAIN DOGS DESIGNATED LIVESTOCK. For the purposes of all clas-
 12    sification and administration of the laws of  the  state  of  Idaho,  and  all
 13    administrative  orders  and  rules  pertaining thereto, the breeding, raising,
 14    boarding, producing or marketing of dogs of the herding, working and  sporting
 15    breeds  by  the producer shall be deemed an agricultural pursuit and such ani-
 16    mals shall be deemed livestock.

 17        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 18    declared to exist, this act shall be in full force and effect on and after its
 19    passage and approval.

This proposed legislation relates to dogs; amending Chapter 28, Title
25, Idaho Code, by the Addition of a new Section 25-2809, Idaho Code,
to provide that the breeding, raising, boarding, producing or
marketing of dogs of the herding, working, and sporting breeds by the
producer shall be deemed an agricultural pursuit and such livestock;
and declaring an emergency.




                          FISCAL NOTE
                               
There will be no impact on the State General Fund.
