  1                                        AN ACT
  2    RELATING TO THE STATE FIRE MARSHAL; AMENDING SECTION 41-253,  IDAHO  CODE,  TO
  3        PROVIDE FOR COUNTYWIDE ENFORCEMENT OF THE INTERNATIONAL FIRE CODE.

  4    Be It Enacted by the Legislature of the State of Idaho:

  5        SECTION  1.  That  Section  41-253, Idaho Code, be, and the same is hereby
  6    amended to read as follows:

  7        41-253.  STATEMENT OF PURPOSE -- ADOPTION OF INTERNATIONAL FIRE CODE.  (1)
  8    The purpose of sections 41-253 through 41-269, Idaho Code, is to protect human
  9    life from fire, and to prevent fires. These sections are intended to prescribe
 10    regulations  consistent with nationally recognized good practice for the safe-
 11    guarding of life and property from hazards of fire and explosion arising  from
 12    the storage, handling and use of hazardous substances, materials, and devices,
 13    and  from  conditions hazardous to life or property in the use or occupancy of
 14    buildings or premises, and there is hereby  adopted  the  "International  Fire
 15    Code,"  2000  edition, with appendices thereto, published by the International
 16    Code Council, Inc. and such later editions as may be so published and  adopted
 17    by the state fire marshal, as the minimum standards for the protection of life
 18    and property from fire and explosions in the state of Idaho.
 19        (2)  The  International  Fire  Code  shall  be  uniformly  enforced  on  a
 20    countywide basis unless specific provisions of the International Fire Code are
 21    exempted by a majority vote of the county commissioners of a county.
 22        (3)  For  the  purposes of sections 41-253 through 41-269, Idaho Code, the
 23    "International Fire Code" shall mean the publications as adopted under subsec-
 24    tion (1) of this section.

                       STATEMENT OF PURPOSE

                             RS 17716

This legislation will ensure uniform enforcement of the
International Fire Code on a countywide basis unless specific
provisions are exempted by a majority vote of the county
commissioners of a county.


                           FISCAL NOTE

There is no fiscal impact to the General Fund.
