from alcohol; to encourage certain establishments to post warning notices
relating to birth defects caused by consumption of alcohol, spirits, wine

provide for the distribution of the notices by the Alcohol Beverage Control

  2    RELATING TO BIRTH DEFECTS FROM ALCOHOL; AMENDING TITLE 23, IDAHO CODE, BY  THE
  3        ADDITION  OF  A NEW CHAPTER 15, TITLE 23, IDAHO CODE, TO ENCOURAGE CERTAIN
  4        ESTABLISHMENTS TO POST WARNING NOTICES RELATING TO BIRTH DEFECTS CAUSED BY
  5        CONSUMPTION OF ALCOHOL, SPIRITS, WINE OR BEER, TO PROVIDE FOR THE  DESIGN-
  6        ING  AND  PRINTING  OF THE WARNING NOTICES BY THE DEPARTMENT OF HEALTH AND
  7        WELFARE, DIVISION OF BEHAVIORAL HEALTH, TO PROVIDE FOR THE DISTRIBUTION OF
  8        THE NOTICES BY THE ALCOHOL BEVERAGE CONTROL DIVISION OF  THE  IDAHO  STATE
  9        POLICE AND TO AUTHORIZE THE DEPARTMENT OF HEALTH AND WELFARE TO PROMULGATE
 10        RULES TO PROVIDE A PROCESS OF RECOGNITION.

 11    Be It Enacted by the Legislature of the State of Idaho:

 12        SECTION  1.  That Title 23, Idaho Code, be, and the same is hereby amended
 13    by the addition thereto of a NEW CHAPTER, to be known and designated as  Chap-
 14    ter 15, Title 23, Idaho Code, and to read as follows:

 15                                      CHAPTER 15
 16                              BIRTH DEFECTS FROM ALCOHOL

 17        23-1501.  BIRTH  DEFECTS  FROM ALCOHOL, SPIRITS, WINE OR BEER -- ENCOURAGE
 18    WARNING NOTICES. The legislature of the state of Idaho acknowledges the poten-
 19    tial for birth defects resulting from the  consumption  of  alcohol,  spirits,
 20    wine  or  beer  shortly  before  conception  or during pregnancy and therefore
 21    encourages any liquor store, distributing station, or other  store  or  estab-
 22    lishment  that sells or serves alcohol, spirits, wine or beer within the state
 23    of Idaho to post conspicuously in two (2) places  within  each  liquor  store,
 24    distributing  station, or other store or establishment, notices in print warn-
 25    ing persons that consumption of alcohol, spirits, wine or beer shortly  before
 26    conception  or during pregnancy can cause birth defects, including fetal alco-
 27    hol syndrome and alcohol related neurological disorders. The Idaho  department
 28    of  health  and welfare, division of behavioral health, shall design and print
 29    the warning notices and provide the notices to the  alcohol  beverage  control
 30    division  of the Idaho state police to be distributed to liquor stores and, in
 31    the process of license renewals, to distributing stations and other stores and
 32    establishments that sell or serve alcohol, spirits, wine or  beer  within  the
 33    state  of  Idaho.  The  alcohol  beverage  control division of the Idaho state
 34    police shall provide replacement  notices  upon  request  at  no  charge.  The
 35    department  of health and welfare is authorized to promulgate rules to provide
 36    a process of recognition for those establishments that voluntarily participate
 37    in the posting of the notices.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17764

The purpose of this legislation is to heighten public awareness,
educate, and aid in prevention of Fetal Alcohol syndrome and
other Alcohol related neurological Disorders by way of signage
placement.


                           FISCAL NOTE

Printing of the signs will be in-house at the Department of
Health and Welfare Division of Behavioral Health, approximate
printing costs $10,000.

There will be no fiscal impact to the general fund for the
printing of signs.

It is the intent of this legislation for the Department of Health
and Welfare to apply for a grant from the Millennium Fund to
cover the costs of the voluntary posting incentives and rewards.
