PUBLIC WORKS CONTRACTORS - Amends existing law to provide that as a
condition for licensure of public works contractors licenses, the licensee
shall provide health insurance to each of its employees that is equivalent
or superior to the coverage the state of Idaho provides for its employees;
to provide that when applying for and renewing a license, the holder of the
license shall show proof of insurance; and to provide that failure to
maintain the required health insurance coverage for its employees shall
subject the licensee to license suspension or revocation.

  1                                        AN ACT
  2    RELATING TO PUBLIC WORKS CONTRACTORS LICENSES; AMENDING SECTION 54-1904, IDAHO
  3        CODE, TO PROVIDE AN ADDITIONAL CONDITION  OF  LICENSURE  REGARDING  HEALTH
  4        INSURANCE FOR EMPLOYEES.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION  1.  That  Section 54-1904, Idaho Code, be, and the same is hereby
  7    amended to read as follows:

  8        54-1904.  CLASSES OF LICENSES -- RIGHTS GRANTED UNDER  LICENSES  --  FEES.
  9    There shall be six (6) classes of licenses issued under the provisions of this
 10    chapter  which  are  hereby  designated as Classes AAA, AA, A, B, C and D, the
 11    maximum fee for which shall be as hereinafter specified. Each applicant for  a
 12    license shall specify the class of license applied for in his application.
 13        For  the  purpose of licensing public works contractors under this chapter
 14    the board may adopt rules necessary to determine the classification  according
 15    to  their  responsibility,  and  the  type  and  scope  of the operations of a
 16    licensed contractor to those in which he is classified and qualified to engage
 17    as in this chapter provided.
 18        Class "AAA" license. Any  contractor  whose  qualifications,  ability  and
 19    responsibility  to  execute  contracts for public works involving an estimated
 20    cost of more than three million dollars ($3,000,000) may, upon his application
 21    and the payment of a license fee not to exceed five hundred dollars ($500), be
 22    granted a Class "AAA" license and be so classified by the board in  accordance
 23    with the provisions of this chapter. The holder of a Class "AAA" license shall
 24    be entitled to engage in the public works contracting business in the state as
 25    provided  in said license. The renewal fee for a Class "AAA" license shall not
 26    exceed five hundred dollars ($500).
 27        Class "AA" license.  Any  contractor  whose  qualifications,  ability  and
 28    responsibility  to  execute  contracts for public works involving an estimated
 29    cost of not more than three million dollars ($3,000,000) may, upon his  appli-
 30    cation  and  the  payment  of a license fee not to exceed four hundred dollars
 31    ($400), be granted a Class "AA" license and be so classified by the  board  in
 32    accordance  with  the  provisions  of this chapter. The holder of a Class "AA"
 33    license shall be entitled to engage in the public works  contracting  business
 34    in  the  state  as  provided in said license. The renewal fee for a Class "AA"
 35    license shall not exceed four hundred dollars ($400).
 36        Class "A"  license.  Any  contractor  whose  qualifications,  ability  and
 37    responsibility  to  execute  contracts for public works involving an estimated
 38    cost of not more than one million dollars ($1,000,000) may, upon his  applica-
 39    tion  and  the  payment  of  a license fee not to exceed three hundred dollars
 40    ($300), be granted a Class "A" license and be so classified by  the  board  in
 41    accordance  with  the  provisions  of  this chapter. The holder of a Class "A"
 42    license shall be entitled to engage in the public works  contracting  business
 43    in  the  state  as  provided  in said license. The renewal fee for a Class "A"

  1    license shall not exceed three hundred dollars ($300).
  2        Class "B"  license.  Any  contractor  whose  qualifications,  ability  and
  3    responsibility  to  execute  contracts for public works involving an estimated
  4    cost of not more than five hundred thousand dollars ($500,000), may, upon  his
  5    application  and  the payment of a license fee not to exceed one hundred fifty
  6    dollars ($150) be granted a Class "B" license and  be  so  classified  by  the
  7    board in accordance with the provisions of this chapter. The holder of a Class
  8    "B"  license shall be entitled to engage in the public works contracting busi-
  9    ness in the state as  provided in said license. The renewal fee  for  a  Class
 10    "B" license shall not exceed one hundred fifty dollars ($150).
 11        Class  "C"  license.  Any  contractor  whose  qualifications,  ability and
 12    responsibility to execute contracts for public works  involving  an  estimated
 13    cost  of  not more than one hundred thousand dollars ($100,000), may, upon his
 14    application and the payment of a license fee not to exceed one hundred dollars
 15    ($100), be granted a Class "C" license and be so classified by  the  board  in
 16    accordance  with  the  provisions  of  this chapter. The holder of a Class "C"
 17    license shall be entitled to engage in the public works  contracting  business
 18    in  the  state  as  provided  in said license. The renewal fee for a Class "C"
 19    license shall not exceed one hundred dollars ($100).
 20        Class "D"  license.  Any  contractor  whose  qualifications,  ability  and
 21    responsibility  to  execute  contracts for public works involving an estimated
 22    cost of not more than fifty thousand dollars ($50,000), may, upon his applica-
 23    tion and the payment of a license fee not to exceed fifty dollars ($50.00), be
 24    granted a Class "D" license and be so classified by the  board  in  accordance
 25    with  the  provisions of this chapter. The holder of a Class "D" license shall
 26    be entitled to engage in the public works contracting business in the state as
 27    provided in said license. The renewal fee for a Class "D"  license  shall  not
 28    exceed fifty dollars ($50.00).
 29        The board shall be vested with the power to fix annually the amount of the
 30    original  and  renewal  license fees for each class of license for the ensuing
 31    license year. The amount of the license fee so fixed shall not exceed the max-
 32    imum fee set forth in this section.
 33        Each license issued by the administrator shall clearly indicate  the  type
 34    and scope of work for which the licensee is qualified and licensed. The holder
 35    of  the  license  shall  be permitted to submit proposals for and perform only
 36    those types of work specified in each license. The  administrator  may  extend
 37    the  permissible type or scope of work to be done under any license when it is
 38    determined by the administrator that the applicant meets all of  the  require-
 39    ments of this chapter to qualify him to do such other work.
 40        As  a  condition of licensure, the licensee shall provide health insurance
 41    to each of its employees that is equivalent or superior to  the  coverage  the
 42    state  of  Idaho  provides  for  its  employees  in terms of services covered,
 43    deductibles and copayments. When applying for  and  renewing  a  license,  the
 44    holder  of  the license shall show proof of insurance. Failure to maintain the
 45    required health insurance coverage for its employees shall subject the  licen-
 46    see  to license suspension or revocation and shall be deemed a material breach
 47    of contract for any public works project the licensee is undertaking  for  the
 48    state of Idaho or any political subdivision of the state.

This legislation amends the public works contractor licensing
requirements to include contractor provided comprehensive health
insurance as an additional condition.


                              FISCAL IMPACT

There is no direct fiscal impact to the General Fund.
