  1                                        AN ACT
  2    RELATING TO PHARMACISTS; AMENDING SECTION 54-1707, IDAHO CODE,  TO  SET  FORTH
  3        EXPERIENCE  FOR PHARMACIST MEMBERS OF THE BOARD OF PHARMACY; AND  AMENDING
  4        SECTION 54-1709, IDAHO CODE, TO REVISE PROVISIONS FOR APPOINTMENT OF BOARD
  5        MEMBERS AND TO MAKE TECHNICAL CORRECTIONS.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION 1.  That Section 54-1707, Idaho Code, be, and the same  is  hereby
  8    amended to read as follows:

  9        54-1707.  MEMBERSHIP. The board of pharmacy shall consist of five (5) mem-
 10    bers.  One  (1)  member  shall be a representative of the public, and four (4)
 11    members shall be licensed pharmacists who possess the qualifications specified
 12    in section 54-1708, Idaho Code. The pharmacist  members  should  have  diverse
 13    pharmacy  practice experience, with at least one (1) member having substantial
 14    experience in retail pharmacy and one member having substantial experience  in
 15    health system pharmacy.

 16        SECTION  2.  That  Section 54-1709, Idaho Code, be, and the same is hereby
 17    amended to read as follows:

 18        54-1709.  APPOINTMENT OF BOARD MEMBERS -- NOTICE OF VACANCY  --  NOMINEES.
 19    Prior  to  the  expiration  of  the regular term of a pharmacist member of the
 20    board or upon the occurrence of declaration of a  vacancy  in  the  pharmacist
 21    membership of the board, the governor shall notify in writing the Idaho Sstate
 22    Ppharmacy  Aassociation,  Iinc. and the Idaho society of health-system pharma-
 23    cists, a nonprofit corporation, thereof, and the association each organization
 24    shall, within thirty (30) days thereafter, nominate three (3)  qualified  per-
 25    sons  pharmacists to fill such vacancy and shall forthwith forward the nomina-
 26    tions to the governor, who may shall thereupon appoint from such nominees, the
 27    person to be a pharmacist member of the board to fill  such  vacancy.  If  the
 28    association aforementioned organizations shall fail to furnish to the governor
 29    the  names  of nominees to fill a vacancy within the time herein provided, the
 30    governor may appoint any person pharmacist otherwise qualified  to  fill  said
 31    vacancy.  The  governor may appoint any person otherwise qualified to fill the
 32    position of the public representative, whether or not said person is nominated
 33    by the aforementioned pharmacy organizations.

                       STATEMENT OF PURPOSE

                             RS 17862

This Act amends section 54-1707, Idaho Code, to allow the Idaho
Society of health-systems pharmacists, pharmacists a vacancy on
the Idaho Board of Pharmacy. The bill also outlines the
experience necessary for pharmacist members of the board
. Furthermore it allows the Governor to appoint any person
otherwise qualified to fill the position of the public
representative whether or not said person is nominated by the
aforementioned pharmacy organizations or not.



                            FISCAL NOTE

There is no fiscal impact to the general fund.
