  2    RELATING TO SCHOLARSHIPS; AMENDING TITLE 33, IDAHO CODE, BY THE ADDITION OF  A
  3        NEW  CHAPTER  57, TITLE 33, IDAHO CODE, TO PROVIDE A SHORT TITLE, TO STATE
  4        LEGISLATIVE INTENT, TO PROVIDE FOR THE PURPOSES OF THE CHAPTER, TO  DEFINE
  5        TERMS,  TO PROVIDE FOR ELIGIBILITY, TO PROVIDE FOR AN APPLICATION PROCESS,
  6        TO PROVIDE FOR APPLICATION CRITERIA, TO PROVIDE FOR A  SELECTION  PROCESS,
  7        TO PROVIDE FOR THE AMOUNT AND DURATION OF AWARDS, TO PROVIDE FOR PROCEDURE
  8        IN THE EVENT OF INELIGIBILITY AND TO CREATE AND PROVIDE FOR A NURSING EDU-
  9        CATOR SCHOLARSHIP PROGRAM FUND.

 10    Be It Enacted by the Legislature of the State of Idaho:

 11        SECTION  1.  That Title 33, Idaho Code, be, and the same is hereby amended
 12    by the addition thereto of a NEW CHAPTER, to be known and designated as  Chap-
 13    ter 57, Title 33, Idaho Code, and to read as follows:

 14                                      CHAPTER 57
 15                        IDAHO NURSING EDUCATOR SCHOLARSHIP ACT

 16        33-5701.  SHORT  TITLE.  This  act  shall be known and cited as the "Idaho
 17    Nursing Educator Scholarship Act."

 18        33-5702.  LEGISLATIVE INTENT. It is the intent of the legislature to  cre-
 19    ate  a  scholarship  fund to provide financial resources to experienced nurses
 20    and nursing graduates to  obtain a graduate degree  so  that  they  can  teach
 21    nursing at the college and university level in Idaho.

 22        33-5703.  PURPOSES. The purposes of this chapter are to:
 23        (1)  Increase  the  opportunity  for  experienced  nurses  to attend post-
 24    secondary educational institutions within Idaho and obtain an advanced  degree
 25    so they can teach nursing at the college or university level;
 26        (2)  To  assist new nursing graduates with bachelor's degrees in obtaining
 27    a graduate degree so they can teach nursing  at  the  college  and  university
 28    level in Idaho; and
 29        (3)  Reduce  the financial burden on experienced nurses and recent nursing
 30    graduates so they can return to school to obtain an advanced degree and  teach
 31    nursing at the college and university level in Idaho.

 32        33-5704.  DEFINITIONS. As used in this chapter:
 33        (1)  "Educational  costs"  means  the dollar amount determined annually by
 34    the state board of education as necessary for student tuition, fees, room  and
 35    board,  books  and  such other expenses reasonably related to attendance at an
 36    eligible Idaho postsecondary educational institution for an experienced nurse.
 37        (2)  "Eligible Idaho postsecondary educational institution" means:
 38        (a)  A public postsecondary organization governed  or  supervised  by  the
 39        state board and the board of regents of the university of Idaho; or

  1        (b)  Any educational organization located in Idaho which is:
  2             (i)   Operated privately;
  3             (ii)  Classified as not-for-profit under the Idaho Code;
  4             (iii) Under the control of an independent board and not directly con-
  5             trolled or administered by a public or political subdivision; and
  6             (iv)  Accredited  by an organization recognized by the state board as
  7             provided in section 33-2402, Idaho Code.
  8        (3)  "Eligible student" means a student who:
  9        (a)  Is an Idaho resident;
 10        (b)  Has a degree in nursing;
 11        (c)  Has enrolled or applied as a student carrying at least six (6) credit
 12        hours per term  to an eligible Idaho postsecondary educational institution
 13        for a graduate degree in nursing; and
 14        (d)  Is pursuing a graduate degree in nursing.
 15        (4)  "Nursing educator scholarship program" means the scholarship  program
 16    described in this chapter and in the rules established by the state board.
 17        (5)  "State board" means the state board of education.

 18        33-5705.  ACADEMIC  AND  FINANCIAL ELIGIBILITY. The state board shall pro-
 19    mulgate rules by August 1, 2008, to determine academic  eligibility consistent
 20    with this section for the purpose  of  awarding  the  Idaho  nursing  educator
 21    scholarship.  In  promulgating  these rules the state board of education shall
 22    consult with representatives of  schools and colleges  of  nursing  in  Idaho,
 23    representatives of Idaho physicians, representatives of Idaho nurses  and rep-
 24    resentatives of Idaho hospitals.

 25        33-5706.  APPLICATION  PROCESS. (1) The state board shall promulgate rules
 26    by August 1, 2008, to establish a process and application  form  for  eligible
 27    persons to apply for a nursing educator scholarship.
 28        (2)  When  applying  for a nursing educator scholarship an eligible person
 29    must:
 30        (a)  Submit to the state board all of the  information  and  documentation
 31        required  to  demonstrate his or her eligibility pursuant to this chapter,
 32        and any other information and documentation the state board may require to
 33        determine the applicant's eligibility for a nursing  educator  scholarship
 34        pursuant to this chapter; and
 35        (b)  Meet  any  other  minimum  criteria established by the state board in
 36        rule.

 37        33-5707.  SELECTION PROCESS -- AMOUNT OF AWARDS  --  CONDITIONS.  (1)  The
 38    state  board  shall  promulgate  rules by August 1, 2008, consistent with this
 39    section, to determine:
 40        (a)  How eligible persons will be selected to receive  the  Idaho  nursing
 41        educator scholarship; and
 42        (b)  When the scholarship award will occur.
 43        (2)  Funds that are available for the nursing educator scholarship program
 44    shall  be  used  to  provide scholarships to the scholarship recipient and the
 45    participating eligible Idaho postsecondary educational  institution  that  the
 46    recipient attends for covering the educational costs for attendance and a liv-
 47    ing stipend for the recipient.
 48        (3)  The  nursing  educator  scholarship award shall not exceed the actual
 49    educational costs at the eligible Idaho postsecondary educational  institution
 50    that  the  student  attends  plus  a living stipend as determined by the state
 51    board. The amount of scholarship awarded for attendance on a  full-time  basis
 52    shall not exceed the recognized educational costs, after deducting the  amount

  1    of  any  other  public  or  private scholarships or grants which the applicant
  2    receives.
  3        (4)  Any scholarship awarded under  this  chapter  shall  not  exceed  the
  4    equivalent  of  eight  (8)  semesters  or  the equivalent of four (4) academic
  5    years. An eligible Idaho postsecondary educational  institution  participating
  6    in  this  program shall be required to submit statements of continuing student
  7    eligibility to the state board, which shall include verification that the stu-
  8    dent is still enrolled, attending full time, maintaining satisfactory academic
  9    progress and has not exceeded the award eligibility terms.
 10        (5)  Grant payments shall correspond to academic terms,  semesters,  quar-
 11    ters or equivalent time periods at an eligible Idaho postsecondary educational
 12    institution.  In  no instance shall the entire amount of a grant be paid to or
 13    on behalf of such student in advance.
 14        (6)  If an eligible student, scholarship applicant or scholarship  recipi-
 15    ent becomes ineligible to participate in the nursing educator scholarship pro-
 16    gram  pursuant  to  this  chapter or the rules established by the state board,
 17    then the eligible student may reapply at any time  for  further  consideration
 18    pursuant to this chapter.
 19        (7)  If a student becomes ineligible for a scholarship under this chapter,
 20    or  if a student discontinues attendance before the end of any semester, quar-
 21    ter, term or equivalent, covered by the grant after  receiving  payment  under
 22    this  chapter,  the eligible Idaho postsecondary educational institution shall
 23    remit, up to the amount of any payments made under this  grant,  any  prorated
 24    tuition, fees or room and board balances to the state board. The student shall
 25    be required to remit, up to the amount of any other reasonable grant balances,
 26    such  grant  balances to the state board.  In the event of extreme hardship as
 27    determined by the state board, a student may request a waiver of remittance.
 28        (8)  An eligible student shall sign an  agreement  committing  himself  or
 29    herself to serving as an instructor of nursing at a school or college of nurs-
 30    ing in Idaho for four (4) years after graduation. If the student does not ful-
 31    fill  this agreement, the student shall be required to remit, up to the amount
 32    of any other reasonable grant balances,  such  grant  balances  to  the  state
 33    board.  In  the  event of extreme hardship as determined by the state board, a
 34    student may request a waiver of remittance.

 35        33-5708.  NURSING EDUCATOR  SCHOLARSHIP PROGRAM FUND. (1) There is  hereby
 36    created  a  fund  in the state treasury to be designated the "Nursing Educator
 37    Scholarship Program Fund."
 38        (2)  The fund shall consist of moneys appropriated to the fund by the leg-
 39    islature, moneys contributed to the fund  from other sources, and the earnings
 40    on such moneys. The executive director of  the  state  board  may  receive  on
 41    behalf  of  the  state  board any moneys or real or personal property donated,
 42    bequeathed, devised or conditionally granted to the state board  for  purposes
 43    of  providing  funding for such fund. Moneys received directly or derived from
 44    the sale of such property shall be deposited by the  state  treasurer  in  the
 45    fund.
 46        (3)  Earnings from moneys in the fund or specified gifts shall be distrib-
 47    uted annually to the state board to implement the nursing educator scholarship
 48    program as provided for pursuant to this chapter.
 49        (4)  All moneys placed in the fund and earnings thereon are hereby perpet-
 50    ually  appropriated to the state board for the purpose described in subsection
 51    (3) of this section. All expenditures from the fund shall be paid out in  war-
 52    rants  drawn by the state controller upon presentation of the proper vouchers.
 53    Up to five percent (5%) of the  annual  earnings  distribution  to  the  state
 54    board,  but not to exceed seventy-five thousand dollars ($75,000), may be used

  1    by the state board annually for administrative costs related to the  implemen-
  2    tation of the provisions of this chapter.
  3        (5)  Allowable administrative costs include, but are not limited to, oper-
  4    ating expenses for the implementation and maintenance of a database, operating
  5    expenses  to  administer  the program, personnel costs necessary to administer
  6    the program and costs related to promoting awareness of the program.
  7        (6)  Pending use, surplus moneys in the fund  shall  be  invested  by  the
  8    state  treasurer  in the same manner as provided for in section 67-1210, Idaho
  9    Code. Interest earned on the investments shall be returned to the fund.

                       STATEMENT OF PURPOSE

Teachers in college nursing staffs are nearing retirement. Nurses
with B.S. degrees are in such demand that going into the private
side is very appealing. This is a scholarship idea to help get
nurses who have a B.S. degree to pursue their education to a
master's degree or doctorate degree to be able to teach on the
college level.


                           FISCAL NOTE

For every $50 dollars donated, it would reduce the tax liability of
the taxpayer by $4 dollars, and there would be a corresponding
reduction in tax revenue to the state.
