                             HOUSE CONCURRENT RESOLUTION NO. 46

                         BY COMMERCE AND HUMAN RESOURCES COMMITTEE

  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND REJECTING A CERTAIN RULE OF THE OFFICE
  3        OF THE GOVERNOR RELATING TO RULES OF THE DIVISION OF HUMAN  RESOURCES  AND
  4        PERSONNEL COMMISSION.

  5    Be It Resolved by the Legislature of the State of Idaho:

  6        WHEREAS,  the  Legislature  is  vested  with authority to reject executive
  7    agency rules under the provisions of Section 67-5291, Idaho Code, in the event
  8    that the Legislature finds that the rules are not consistent with  legislative
  9    intent; and
 10        WHEREAS,  it  is the finding of the Legislature that a certain rule of the
 11    Office of the Governor relating to Rules of the Division  of  Human  Resources
 12    and  Personnel Commission is not consistent with legislative intent and should
 13    be rejected.
 14        NOW, THEREFORE, BE IT RESOLVED by the members of the Second  Regular  Ses-
 15    sion  of  the  Fifty-ninth Idaho Legislature, the House of Representatives and
 16    the Senate concurring therein, that IDAPA 15.04.01, Rules of the  Division  of
 17    Human  Resources  and  Personnel  Commission,  adopted as a pending rule under
 18    Docket Number 15-0401-0702, the Office of the Governor, the entire  rulemaking
 19    docket,  be, and the same is hereby rejected and declared null, void and of no
 20    force and effect.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17902

This concurrent resolution would reject a pending rule of the
Office of the Governor relating to Rules of the Division of Human
Resources and Personnel Commission.  The effect of this
resolution, if adopted by both houses, would be to prevent the
agency rule from going into effect.


                           FISCAL NOTE  

This concurrent resolution has no fiscal impact.
