]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1259 BY MCGEE 1 AN ACT 2 RELATING TO ALBERTSON COLLEGE OF IDAHO; AMENDING SECTION 49-418A, IDAHO CODE, 3 TO PROVIDE CORRECT TERMINOLOGY AND TO MAKE A TECHNICAL CORRECTION; AND 4 AMENDING SECTION 67-5205, IDAHO CODE, TO PROVIDE CORRECT TERMINOLOGY; AND 5 DECLARING AN EMERGENCY. 6 Be It Enacted by the Legislature of the State of Idaho: 7 SECTION 1. That Section 49-418A, Idaho Code, be, and the same is hereby 8 amended to read as follows: 9 49-418A. IDAHO COLLEGE AND UNIVERSITY PLATES. (1) Any person who is the 10 owner of a vehicle registered under the provisions of section 49-402 or 11 49-434(1), Idaho Code, may apply for special plates featuring one (1) of 12 Idaho's colleges or universities. The provisions of this section shall not 13 apply to any vehicle with a registered maximum gross weight over twenty-six 14 thousand (26,000) pounds. Availability of Idaho college and university special 15 license plates for other vehicles may be authorized by rule of the board. 16 (2) In addition to the regular operating fee, the applicant shall be 17 charged a fee of thirty-five dollars ($35.00) for the initial issuance of the 18 plates, and twenty-five dollars ($25.00) upon each succeeding annual registra- 19 tion. Ten dollars ($10.00) of the initial fee and ten dollars ($10.00) of the 20 renewal fee shall be deposited in the state highway account to be used by the 21 department to fund highway, road and bridge construction projects and to fund 22 the cost of administration of this special license plate program. The depart- 23 ment shall transfer twenty-five dollars ($25.00) of the initial fee and fif- 24 teen dollars ($15.00) of the renewal fee for deposit to the institution desig- 25 nated on the license plate. 26 (3) Whenever title or interest in a vehicle registered under the provi- 27 sions of this section is transferred or assigned, the owner may transfer the 28 special plates to another vehicle upon payment of the required transfer fees. 29 The owner may only display the plates after receipt of new registration from 30 the department. 31 (4) All special college and university plates shall be of a color and 32 design comparable to the standard issue of license plates with blue numerals 33 on a red, white and blue background and shall indicate the participating 34 institution. 35 (a) The standard red, white and blue graphic shall be used, except that 36 the word "Idaho" and "Famous Potatoes" shall appear on every plate, the 37 identification of county shall be omitted, and the inscription "Scenic 38 Idaho" may be omitted. 39 (b) Each college or university that chooses to participate in this pro- 40 gram shall provide that portion of the design which features the particu- 41 lar institution and such design shall be acceptable to the president of 42 the institution. For public colleges and universities, approval of the 43 state board of education and board of regents of the university of Idaho 2 1 shall also be required. 2 Each version of the special college and university plate featuring the 3 participating college or university shall be approved by the department, uti- 4 lizing a numbering system as determined by the department. Initial costs of 5 the plate program, including the cost of plate design, shall be paid by the 6 participating college or university. 7 (5) The state board of education and board of regents of the university 8 of Idaho shall adopt rules to account for receipt and distribution of revenues 9 accruing to participating public colleges and universities from the special 10 license plate program. Revenues from the special plate program shall be used 11 to: 12 (a) Fund scholarships for Idaho residents attending that college or uni- 13 versity. 14 (b) Match funds contributed in equal amounts from nonstate sources for 15 academic programs, provided that such expenditures for public colleges and 16 universities shall be subject to prior approval by the state board of edu- 17 cation and board of regents of the university of Idaho. 18 (6) For the purposes of this section, nonpublic colleges and universities 19 shall mean and are limited to:AlbertsonThe College of Idaho located in 20 Caldwell, Idaho; Northwest Nazarene University located in Nampa, Idaho; and 21 Brigham Young University-Idaho located in Rexburg, Idaho. 22 (7) Sample college and university license plates may be purchased from 23 the department for a fee of thirty dollars ($30.00), ten dollars ($10.00) of 24 which shall be retained by the department for deposit to the state highway 25 account and twenty dollars ($20.00) of which shall be transferred by the 26 department to the college or university designated on the license plate. No 27 additional fee shall be charged for personalizing sample plates. 28 SECTION 2. That Section 67-5205, Idaho Code, be, and the same is hereby 29 amended to read as follows: 30 67-5205. FORMAT -- COSTS -- DISTRIBUTION -- FUNDS. (1) The administrative 31 code and the permanent supplements thereto shall be published in such a manner 32 that every agency has an opportunity to procure at reasonable cost from the 33 coordinator, individual printed pamphlet copies of the rules and statements of 34 policy of such agency published by authority of this chapter. No administra- 35 tive rule or statement of policy published in the administrative code or the 36 permanent supplements shall be reset or otherwise reprinted at public expense 37 upon a format distinct from that of the administrative code without a certifi- 38 cation by the coordinator that such special format is necessary for the effec- 39 tive performance by the agency of its functions. 40 (2) The prices to be charged for individual copies of and subscriptions 41 to the administrative code, the permanent supplements thereto and the bulle- 42 tin, for reprints and bound volumes thereof and for pamphlet rules and state- 43 ments of policy, which prices may be fixed without reference to the restric- 44 tions placed upon and fixed for the sale of other publications of the state, 45 and the number of copies which shall be distributed free for official use, in 46 addition to those free copies required to be as provided in this section, 47 shall be set by rules promulgated by the coordinator. The coordinator may set 48 prices without reference to the restrictions placed upon the sale of other 49 publications of the state. Free copies shall be distributed by the coordina- 50 tor, as follows: 51 (a) One (1) to each county clerk for the use of the county law library. 52 (b) One (1) each to the senate and the house of representatives. 53 (c) One (1) to the attorney general. 3 1 (d) One (1) to the legislative services office. 2 (e) One (1) each to the state universities and colleges, and one (1) to 3 each community college. 4 (f) One (1) to the state law library. 5 (g) One (1) to the commission for libraries. 6 (h) One (1) each to the following state depository libraries: Boise Pub- 7 lic Library, East Bonner County Library, Idaho Falls Public Library, Lew- 8 iston City Library, Pocatello Library,AlbertsonThe College of Idaho 9 Library, Brigham Young University-Idaho Library and Twin Falls Public 10 Library. 11 In addition to those free copies required to be distributed by this section, 12 the coordinator shall provide to the legislature free copies of all rules sub- 13 ject to review by the legislature pursuant to section 67-5291, Idaho Code, and 14 may distribute other free copies for official use. 15 (3) Without limiting the generality of the provisions of subsection (2) 16 of this section, the rules of the coordinator may provide for volume discounts 17 to be available to established law book publishers who agree to incorporate 18 fully administrative rules, the permanent supplements thereto and the bulletin 19 into their general scheme of promotion and distribution, and may provide for 20 the free reciprocal exchange of publications between this state and other 21 states and foreign jurisdictions. The provisions of this section include the 22 authority to exchange, display, access and publish texts through electronic 23 media. 24 (4) There is hereby created in the state treasury the administrative code 25 fund. All moneys received from the production of rules, the sale of the admin- 26 istrative code, the permanent supplements thereto, or the bulletin, and for 27 providing electronic access, shall be deposited in the fund. All agencies 28 which have any material published in the bulletin, administrative code or sup- 29 plements thereto, or newspapers, are hereby authorized and directed to pay out 30 of their appropriations to the coordinator their respective shares of the 31 costs of publication and distribution of such material. All moneys placed in 32 the fund may be appropriated to the coordinator for the administration of the 33 provisions of this chapter, and for the publication and distribution of the 34 bulletin, administrative code or supplements thereto, as authorized in this 35 chapter. 36 The coordinator shall charge an annual fee to each participating agency 37 for each page published in the administrative code not to exceed fifty-six 38 dollars ($56.00) per page. In addition, the coordinator shall charge a fee to 39 each participating agency for each page published in the bulletin not to 40 exceed sixty-one dollars ($61.00) per page. A fee per page may be charged even 41 though less than a full page of publication is required, and each participat- 42 ing agency shall promptly pay into the administrative code fund such charge. 43 SECTION 3. An emergency existing therefor, which emergency is hereby 44 declared to exist, this act shall be in full force and effect on and after its 45 passage and approval.
STATEMENT OF PURPOSE RS 17445 The purpose of this legislation is to change "Albertson College of Idaho" to "The College of Idaho" in light of the institutions recent name change.
