]]]] LEGISLATURE OF THE STATE OF IDAHO ]]]] Fifty-ninth Legislature Second Regular Session - 2008IN THE SENATE SENATE BILL NO. 1268 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO FISH AND GAME; AMENDING SECTION 36-123, IDAHO CODE, TO REVISE PRO- 3 VISIONS RELATING TO THE APPOINTMENT OF WINTER FEEDING ADVISORY COMMITTEES. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Section 36-123, Idaho Code, be, and the same is hereby 6 amended to read as follows: 7 36-123. WINTER FEEDING ADVISORY COMMITTEES. (1) A winter feeding advisory 8 committee shall be established for each district where winter feeding of ante- 9 lope, elk, and deer normally occurs. Each committee shall consist of five (5) 10 members. The members shall be appointed and removed for cause by unanimous 11 vote of the Idaho fish and game commission.The regional wildlife councils12will provide a list of appointees.It is intended that the committees reflect 13 the cross section of the major interest groups associated with each district. 14 Each committee shall meet at such times as appropriate, but not less fre- 15 quently than annually, on or before December 1, before the winter feeding sea- 16 son arrives, whichever is earlier. 17 (2) The term of office of a member shall be two (2) years, except a por- 18 tion of the initial appointments may be for a term of one (1) year to provide 19 staggered terms. Appointments to fill vacancies shall be for the balance of 20 the unexpired term. The committees shall serve without compensation. 21 (3) Each winter feeding advisory committee established pursuant to sub- 22 section (1) of this section shall appoint a chairman. The chairmen of the com- 23 mittees shall meet at least annually to coordinate activities and promote con- 24 sensus on issues of common interest among the winter feeding advisory commit- 25 tees. The chairmen may elect a leader from among the chairmen to call meetings 26 and conduct and coordinate activities of the group. 27 (4) The department of fish and game shall provide staff assistance and 28 support for the committees. 29 (5) The committees shall have the authority to: 30 (a) Act as an independent resource in each district to give advice and 31 recommendations on the administration of winter feeding programs; 32 (b) Act as a liaison between the commission, the department, interest 33 groups, and the public on winter feeding issues.
STATEMENT OF PURPOSE
RS 17315
This bill amends existing law relating to the Department Fish
and Game to strike reference to regional wildlife councils
providing a list of appointees for the winter feeding advisory
committees. There are no longer functional regional wildlife
councils in all districts where winter feeding occurs.
FISCAL NOTE
There is no fiscal effect to the General Fund or Fish and Game
funds.
