                                    SENATE BILL NO. 1271

                              BY JUDICIARY AND RULES COMMITTEE

  1                                        AN ACT
  2    RELATING TO THE STATE LAW LIBRARY; AMENDING  SECTION  4-101,  IDAHO  CODE,  TO
  3        DELETE THE PROVISION THAT THE STATE LAW LIBRARY BE KEPT IN THE STATE CAPI-
  4        TOL  OR THE SUPREME COURT AND LAW LIBRARY BUILDING; AND DECLARING AN EMER-
  5        GENCY.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION 1.  That Section 4-101, Idaho Code, be, and  the  same  is  hereby
  8    amended to read as follows:

  9        4-101.  ESTABLISHMENT  OF A STATE LAW LIBRARY. A state law library for the
 10    use of the courts and members of the bar of this state is  hereby  established
 11    in  the  city of Boise. The Boise state law library shall be kept in the state
 12    capitol building or the Supreme Court and law library building, and is  hereby
 13    also  designated  as  the  state depository for official publications received
 14    from other states and the federal government.

 15        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 16    declared to exist, this act shall be in full force and effect on and after its
 17    passage and approval.

                    STATEMENT OF PURPOSE

  This bill provides that the State Law Library will
  continue to be in Boise, but removes the requirement that it
  be located in either the State Capitol or the Supreme Court
  building.  This will allow greater flexibility and
  efficiency in the use of the Supreme Court building and open
  up additional options for housing the State Law Library. 
  The bill contains an emergency clause, which will permit
  moving the State Law Library and remodeling and use of the
  present Law Library space in the most timely and efficient
  manner during the current fiscal year.
  
  
                        FISCAL NOTE
