                                    SENATE BILL NO. 1273

                              BY JUDICIARY AND RULES COMMITTEE

  1                                        AN ACT
  2    RELATING TO CRUELTY TO ANIMALS;  AMENDING  SECTION  25-3504,  IDAHO  CODE,  TO
  3        REVISE  THE CRIME OF COMMITTING CRUELTY TO ANIMALS; AND DECLARING AN EMER-
  4        GENCY.

  5    Be It Enacted by the Legislature of the State of Idaho:

  6        SECTION 1.  That Section 25-3504, Idaho Code, be, and the same  is  hereby
  7    amended to read as follows:

  8        25-3504.  COMMITTING  CRUELTY TO ANIMALS. Every person who is cruel to any
  9    animal, or who causes or procures any animal to be cruelly treated;  and  who-
 10    ever,  or  who, having the charge or custody of any animal, either as owner or
 11    otherwise, subjects any animal to cruelty, is, for every such offense,  guilty
 12    of  a  misdemeanor  and shall, upon conviction, be punished in accordance with
 13    section 25-3520A, Idaho Code. Any law enforcement officer or animal  care  and
 14    control  officer, subject to the restrictions of section 25-3501A, Idaho Code,
 15    may take possession of the animal cruelly treated, and provide  care  for  the
 16    same,  until final disposition of such animal is determined in accordance with
 17    section 25-3520A or 25-3520B, Idaho Code.

 18        SECTION 2.  An emergency existing  therefor,  which  emergency  is  hereby
 19    declared to exist, this act shall be in full force and effect on and after its
 20    passage and approval.

                     STATEMENT OF PURPOSE

                           RS 17472

This legislation amends Idaho's animal cruelty statute to
clarify that the statute's provisions apply to persons who are
not the animal's owner.


                         FISCAL NOTE

There is no fiscal impact to the state's general fund.
