  1                                        AN ACT
  2    RELATING TO APPROPRIATIONS TO THE DEPARTMENT OF WATER RESOURCES; APPROPRIATING
  3        ADDITIONAL MONEYS TO THE DEPARTMENT OF WATER  RESOURCES  FOR  FISCAL  YEAR
  4        2008;  REDUCING THE APPROPRIATION TO THE DEPARTMENT OF WATER RESOURCES FOR
  5        FISCAL YEAR 2008; AMENDING SECTION 2, CHAPTER 299, LAWS OF 2007,  TO  PRO-
  6        VIDE A CORRECT EFFECTIVE DATE AND TO REAPPROPRIATE UNEXPENDED AND UNENCUM-
  7        BERED  MONEYS  TO THE OFFICE OF ENERGY RESOURCES FOR FISCAL YEAR 2009; AND
  8        DECLARING AN EMERGENCY.

  9    Be It Enacted by the Legislature of the State of Idaho:

 10        SECTION 1.  In addition to the appropriation made in  Section  1,  Chapter
 11    321,  Laws  of  2007,  there is hereby appropriated to the Department of Water
 12    Resources the following amount to  be  expended  for  the  designated  program
 13    according  to  the  designated  expense  classes  from the listed fund for the
 14    period July 1, 2007, through June 30, 2008:
 15    ENERGY RESOURCES:

 17    Personnel Costs                                                       $169,600
 18    Operating Expenditures                                                  43,300
 19      TOTAL                                                               $212,900
 20    FROM:
 21    Miscellaneous Revenue Fund                                            $212,900

 22        SECTION 2.  The appropriation made in Section  1,  Chapter  321,  Laws  of
 23    2007,  to the Department of Water Resources is hereby reduced by the following
 24    amount for the designated program according to the designated expense  classes
 25    from the listed fund for the period July 1, 2007, through June 30, 2008:

 32    Petroleum Price Violation Fund                                        $212,900

 33        SECTION 3.  That Section 2, Chapter 299, Laws of 2007, be, and the same is
 34    hereby amended to read as follows:

 35        SECTION  2.  In addition to any other appropriation provided by law, there
 36    is hereby appropriated to the Department of Water  Resources  for  the  Energy
 37    Resources  Program  the  sum  of  $690,000 from the Idaho Economic Development
 38    Biofuel Infrastructure Matching Grant Fund to be used for matching grants pur-
 39    suant to Section 42-1806, Idaho Code, for the period July  1,  20087,  through
 40    June 30, 20098. Any unexpended and unencumbered moneys remaining at the end of
 41    fiscal  year  2008 are hereby reappropriated to the Office of Energy Resources

  1    in the Office of the Governor to be used for the same purposes for the  period
  2    July 1, 2008, through June 30, 2009.

  3        SECTION  4.  An  emergency  existing  therefor,  which emergency is hereby
  4    declared to exist, this act shall be in full force and effect on and after its
  5    passage and approval.

This legislation amends the fiscal year 2008 appropriation to the Idaho Department of Water Resources for the Energy Resources program for two purposes. First, it provides a fund shift to increase spending authority for grant monies received from the Northwest Energy Efficiency Alliance with an equal reduction in spending authority from other dedicated funds. Second, the legislation corrects a drafting error made last session regarding the effective date of the Biofuel Match appropriation and provides carryover of any unspent Biofuel Match funds from fiscal year 2008 into the Office of Energy Resources in the Governor’s Office instead of the Department of Water Resources.

Fiscal Note

This legislation increases the appropriation to the Department of Water Resources Miscellaneous Revenue Fund by $212,900 in ongoing spending authority and reduces the Petroleum Price Violation Fund by a like amount for a net change of zero dedicated funds. It also corrects a drafting error to allow the Rural Idaho Economic Development Biofuel Infrastructure Fund to be expended in FY 2008 with carryover of any unspent and unencumbered monies to the Office of Energy Resources in the Governors Office.
