  1                                        AN ACT
  2    RELATING TO SPECIAL MOTOR VEHICLE LICENSE  PLATES;  AMENDING  SECTION  49-402,
  3        IDAHO  CODE,  TO  PROVIDE  A CODE REFERENCE; AMENDING CHAPTER 4, TITLE 49,
  4        IDAHO CODE, BY THE ADDITION OF A  NEW  SECTION  49-417D,  IDAHO  CODE,  TO
  5        ESTABLISH  AN  IDAHO  RANGELAND  SPECIAL  PLATE  PROGRAM; AND PROVIDING AN
  6        EFFECTIVE DATE.

  7    Be It Enacted by the Legislature of the State of Idaho:

  8        SECTION 1.  That Section 49-402, Idaho Code, be, and the  same  is  hereby
  9    amended to read as follows:

 10        49-402.  ANNUAL REGISTRATION. (1) The annual fee for operating each pickup
 11    truck,  each neighborhood electric vehicle and each other motor vehicle having
 12    a maximum gross weight not in excess of eight thousand  (8,000)  pounds  shall
 13    be:
 14        Vehicles one (1) and two (2) years old ............................ $48.00
 15        Vehicles three (3) and four (4) years old ......................... $36.00
 16        Vehicles five (5) and six (6) years old ........................... $36.00
 17        Vehicles seven (7) and eight (8) years old ........................ $24.00
 18        Vehicles over eight (8) years old ................................. $24.00
 19        There  shall  be twelve (12) registration periods, starting in January for
 20    holders of validation registration stickers numbered 1, and proceeding consec-
 21    utively through December for holders of validation registration stickers  num-
 22    bered  12,  each of which shall start on the first day of a calendar month and
 23    end on the last day of the twelfth month from the first day of  the  beginning
 24    month.  Registration periods shall expire midnight on the last day of the reg-
 25    istration period  in  the  year  designated  by  the  validation  registration
 26    sticker.  The  numeral digit on the validation registration stickers shall, as
 27    does the registration card, fix the registration period  under  the  staggered
 28    plate  system of Idaho for the purpose of reregistration and notice of expira-
 29    tion.
 30        A vehicle that has once been registered for any of  the  above  designated
 31    periods  shall,  upon reregistration, be registered for the period bearing the
 32    same number, and the registration card shall show and be the  exclusive  proof
 33    of  the  expiration  date  of registration and licensing. Vehicles may be ini-
 34    tially registered for less than a twelve (12) month period, or for more than a
 35    twelve (12) month period, and the fee prorated on a monthly basis if the frac-
 36    tional registration tends to fulfill the purpose of the monthly series  regis-
 37    tration system.
 38        (2)  For all school buses operated either by a nonprofit, nonpublic school
 39    or  operated  pursuant to a service contract with a school district for trans-
 40    porting children to or from school  or  in  connection  with  school  approved
 41    activities, the annual fee shall be twenty-four dollars ($24.00).
 42        (3)  For all motorcycles and all-terrain vehicles operated upon the public
 43    highways  the  annual  fee  shall be nine dollars ($9.00). For operation of an

  1    all-terrain vehicle or motorcycle off the public highways, the  fee  specified
  2    in  section  67-7122,  Idaho Code, shall be paid. Registration exemptions pro-
  3    vided in section 49-426(2), (3) and (4),  Idaho  Code,  apply  to  all-terrain
  4    vehicles  and  motorcycles used for the purposes described in subsections (2),
  5    (3) and (4) of section 49-426, Idaho Code.
  6        (4)  For all motor homes the fee shall be as specified in  subsection  (1)
  7    of   this section and shall be in addition to the fees provided for in section
  8    49-445, Idaho Code.
  9        (5)  Registration fees shall not be subject to refund.
 10        (6)  A financial institution  or  repossession  service  contracted  to  a
 11    financial  institution  repossessing  vehicles  under  the terms of a security
 12    agreement shall move the vehicle from the place of repossession to the  finan-
 13    cial institution's place of business on a repossession plate. The repossession
 14    plate  shall  also be used for demonstrating the vehicle to a prospective pur-
 15    chaser for a period not to exceed ninety-six (96) hours. The registration fees
 16    for repossession plates shall be as required in subsection (1) of this section
 17    for a vehicle one (1) and two (2) years old. All  other  fees  required  under
 18    chapter 4, title 49, Idaho Code, shall be in addition to the registration fee.
 19    The repossession plate shall be issued on an annual basis by the department.
 20        (7)  In  addition  to  the  annual registration fee in this section, there
 21    shall be an initial program fee of twenty-five dollars ($25.00) and an  annual
 22    program fee of fifteen dollars ($15.00) for all special license plate programs
 23    for  those license plates issued pursuant to sections 49-404A, 49-407, 49-408,
 24    49-409, 49-414, 49-416, 49-418 and 49-418D, Idaho  Code.  For  special  plates
 25    issued  pursuant to sections 49-406 and 49-406A, Idaho Code, there shall be an
 26    initial program fee of twenty-five dollars ($25.00)  but  there  shall  be  no
 27    annual  renewal  fee.  For special plates issued pursuant to sections 49-415C,
 28    49-415D,  49-416A,  49-416B,  49-416C,  49-416D,  49-416E,  49-417,   49-417A,
 29    49-417B,   49-417C,  49-417D,  49-418A,  49-418B,  49-418C,  49-418E,  49-419,
 30    49-419A,  49-419B,  49-419C,  49-419D,  49-420,  49-420A,  49-420B,   49-420C,
 31    49-420D,  49-420E  and  49-420G, Idaho Code, there shall be an initial program
 32    fee of thirty-five dollars ($35.00) and an annual program fee  of  twenty-five
 33    dollars ($25.00). The fees contained in this subsection shall be applicable to
 34    all new special plate programs. The initial program fee and the annual program
 35    fee  shall be deposited in the state highway account and shall be used to fund
 36    the cost of administration of special license plate programs, unless otherwise
 37    specified by law.

 38        SECTION 2.  That Chapter 4, Title 49, Idaho Code,  be,  and  the  same  is
 39    hereby  amended by the addition thereto of a NEW SECTION, to be known and des-
 40    ignated as Section 49-417D, Idaho Code, and to read as follows:

 41        49-417D.  IDAHO RANGELAND PLATES. (1) On and after January  1,  2009,  any
 42    person  who  is the owner of a vehicle registered under the provisions of sec-
 43    tion 49-402 or 49-434(1), Idaho Code, may apply for  Idaho  rangeland  plates.
 44    The  provisions  of  this section shall not apply to any vehicle with a regis-
 45    tered maximum gross weight over twenty-six thousand  (26,000)  pounds.  Avail-
 46    ability of Idaho rangeland plates for other vehicles may be authorized by rule
 47    of the board.
 48        (2)  In  addition  to the regular registration fee, the applicant shall be
 49    charged a fee of thirty-five dollars ($35.00) for the initial issuance of  the
 50    plates, and twenty-five dollars ($25.00) upon each succeeding annual registra-
 51    tion.  Ten dollars ($10.00) of the initial fee and ten dollars ($10.00) of the
 52    renewal fee shall be deposited in the state highway account and shall be  used
 53    to  fund the cost of the administration of this special license plate program.

  1    Twenty-five dollars ($25.00) of each initial fee and fifteen dollars  ($15.00)
  2    of  each  renewal  fee shall be transferred by the state treasurer to an Idaho
  3    rangeland resource commission account provided in section 58-1415, Idaho Code.
  4        (3)  Whenever title or interest in a vehicle registered under  the  provi-
  5    sions  of  this section is transferred or assigned, the owner may transfer the
  6    special plates to another vehicle upon payment of the required transfer  fees.
  7    The  owner  may only display the plates after receipt of new registration from
  8    the department.
  9        (4)  The Idaho rangeland license plate shall be of a color and  design  in
 10    accordance with the provisions of section 49-402C, Idaho Code. That portion of
 11    the  design  which  features Idaho rangelands shall be acceptable to the Idaho
 12    rangeland resource commission and shall be approved by the department  utiliz-
 13    ing  a  numbering system as determined by the department. Initial costs of the
 14    plate program, including the cost of plate design,  shall  be  paid  from  the
 15    Idaho rangeland resource commission account.
 16        (5)  Sample  Idaho  rangeland  plates may be purchased from the department
 17    for a fee of thirty dollars ($30.00), ten dollars ($10.00) of which  shall  be
 18    deposited  in  the  state highway account and twenty dollars ($20.00) of which
 19    shall be transferred to the Idaho rangeland resource commission account.

 20        SECTION 3.  This act shall be in full force and effect on and after  Janu-
 21    ary 1, 2009.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE

                             RS 17675

The purpose of this proposed legislation is to provide for an
Idaho Rangeland license plate.  The net proceeds from the sale of
these plates will go to the Idaho Rangeland Resource Commission
and be used for the purposes as set forth in Idaho Code 58-1408.



                          FISCAL IMPACT
