  1                                        AN ACT
  2    APPROPRIATING MONEYS TO THE DEPARTMENT OF LABOR FOR FISCAL YEAR 2009; LIMITING
  3        THE NUMBER OF FULL-TIME EQUIVALENT POSITIONS; APPROPRIATING CERTAIN MONEYS
  4        TO THE DEPARTMENT OF LABOR FOR FISCAL  YEAR  2009;  PROVIDING  LEGISLATIVE
  5        INTENT  REGARDING  CERTAIN  EMPLOYEES;  DIRECTING  THE STATE CONTROLLER TO
  6        TRANSFER MONEYS TO THE MISCELLANEOUS REVENUE FUND; AND DIRECTING THE STATE
  7        CONTROLLER TO TRANSFER MONEYS TO THE GENERAL FUND.

  8    Be It Enacted by the Legislature of the State of Idaho:

  9        SECTION 1.  There is hereby appropriated to the Department  of  Labor  the
 10    following amounts from the listed funds to be expended according to the desig-
 11    nated expense classes for the period July 1, 2008, through June 30, 2009:

 34        SECTION 2.  In accordance with Section 67-3519, Idaho Code, the Department
 35    of  Labor  is  authorized no more than eleven and sixty-six hundredths (11.66)
 36    full-time equivalent positions at any point during the period  July  1,  2008,
 37    through  June  30,  2009,  for the program specified in Section 1 of this act,
 38    unless  specifically  authorized  by  the   Governor.   The   Joint   Finance-
 39    Appropriations  Committee will be notified promptly of any increased positions
 40    so authorized.

 41        SECTION 3.  There is hereby appropriated out of the funds  made  available

  1    to  the  Department of Labor of the State of Idaho, pursuant to Section 903 of
  2    the federal Social Security Act, as amended, the sum  of  $2,500,000  for  the
  3    payment of expenses incurred for the administration of the Unemployment Insur-
  4    ance and the Employment Service Programs. This appropriation is authorized and
  5    subject  to the limitations of Section 72-1346(4), Idaho Code. This appropria-
  6    tion is for the period July 1, 2008, through June 30, 2009.

  7        SECTION 4.  It is legislative intent that Reed Act moneys appropriated  in
  8    Section 3 of this act, shall expressly be used to retain employees in tax col-
  9    lection and claims investigation.

 10        SECTION  5.  On July 1, 2008, or as soon thereafter as possible, the State
 11    Controller shall transfer $25,000 from the Incumbent Worker Training Revolving
 12    Loan Fund to the Miscellaneous Revenue Fund within the Department of Labor.

 13        SECTION 6.  On July 1, 2008, or as soon thereafter as possible, the  State
 14    Controller shall transfer the balance of the Incumbent Worker Training Revolv-
 15    ing Loan Fund to the General Fund.
