APPROPRIATIONS - HEALTH EDUCATION PROGRAMS - STATE BOARD OF EDUCATION -
Appropriates $10,034,000 to the State Board of Education and the Board of
Regents of the University of Idaho for Health Education Programs including
the WOI Veterinary Education Program, WWAMI Medical Education Program,
Idaho Dental Education Program, University of Utah Medical Education
Program, the Family Practice Residency Program, WICHE and Psychiatry
Residency for fiscal year 2009; limits the number of full-time equivalent
positions to 20.39; and reappropriates any unexpended and unencumbered fund
balances for nonrecurring expenditures.

  1                                        AN ACT
  2    APPROPRIATING MONEYS FOR THE HEALTH EDUCATION PROGRAMS FOR FISCAL  YEAR  2009;
  3        LIMITING  THE  NUMBER  OF  FULL-TIME EQUIVALENT POSITIONS; REAPPROPRIATING
  4        CERTAIN UNEXPENDED AND UNENCUMBERED BALANCES FOR  THE  SEVERAL  DESIGNATED
  5        PROGRAMS; AND SETTING CONDITIONS FOR REAPPROPRIATION.

  6    Be It Enacted by the Legislature of the State of Idaho:

  7        SECTION  1.  There  is  hereby appropriated to the Board of Regents of the
  8    University of Idaho and the State Board of Education the following amounts  to
  9    be  expended  for  the designated programs according to the designated expense
 10    classes from the listed funds for the period July 1, 2008,  through  June  30,

 19        SECTION  2.  In  accordance  with  Section  67-3519,  Idaho Code, there is
 20    authorized no more than twenty and thirty-nine  hundredths  (20.39)  full-time
 21    equivalent positions at any point during the period July 1, 2008, through June
 22    30,  2009,  for the  WOI Veterinary Education Program, WWAMI Medical Education
 23    Program, Idaho Dental Education Program and Family Practice  Residencies  Pro-
 24    gram  as specified in Section 1 of this act, unless specifically authorized by
 25    the Governor. The Joint  Finance-Appropriations  Committee  will  be  notified
 26    promptly of any increased positions so authorized.

 27        SECTION  3.  There is hereby reappropriated to the Board of Regents of the
 28    University of Idaho and the State Board of Education for  the  WOI  Veterinary
 29    Education  Program,  WWAMI  Medical  Education Program, Idaho Dental Education
 30    Program,  University  of  Utah  Medical  Education  Program,  Family  Practice
 31    Residencies Program, the WICHE Program and the  Psychiatry  Residency  Program
 32    subject  to  the provisions of Section 4 of this act, the unexpended and unen-
 33    cumbered balance of any appropriation contained in  Section  1,  Chapter  156,
 34    Laws of 2007, to be used for nonrecurring expenditures, for the period July 1,
 35    2008, through June 30, 2009.

 36        SECTION  4.  The  reappropriation  for  the General Fund moneys granted in
 37    Section 3 of this act shall be subject to the following provisions:
 38        (1)  If the unexpended and unencumbered balance in  the  General  Fund  on
 39    June  30,  2008,  is  zero, the reappropriation for the General Fund moneys in
 40    Section 3 is hereby declared to be null and void.
 41        (2)  If the unexpended and unencumbered balance in  the  General  Fund  on
 42    June  30,  2008, is greater than zero but less than the total General Fund re-
 43    appropriation authority granted to all state agencies, that amount reappropri-
 44    ated in Section 3 of this act shall be in the proportion that the reappropria-
 45    tion for the Board of Regents of the University of Idaho and the  State  Board
 46    of Education bears to the total General Fund reappropriation authority granted
 47    to all state agencies.

Line Item #4 provides the second year of funding for the Psychiatry Residency Program. This program was first funded in FY 2008, with funding being built-out over four years. Total state base funding at build-out will be $114,000, which will reflect approximately 10% of the total program budget.
