CHAPTER 12

MAINTENANCE AND REPAIR OF DITCHES

42-1211.  LIABILITY FOR WASTE OF WATER. Any person entitled to the use of water from any ditch, canal, or conduit who willfully or wantonly wastes water in a manner that causes injury or damage to another person’s real property shall be liable in a civil action to the owner of the injured or damaged real property.
