DEPARTMENT OF HEALTH AND WELFARE

56-1006.  Title superseded. Except with respect to environmental protection functions, wherever the words "board of health" or "board of health and welfare" appear in the Idaho Code, they shall mean the department of health and welfare, and wherever the words "administrator of health" appear in the Idaho Code, they shall mean the director of the department of health and welfare, and wherever the words "department of health" appear in the Idaho Code, they shall mean the department of health and welfare. Notwithstanding any other provision of law to the contrary, all rulemaking vested in the board of health and welfare shall now be vested in the department. Nothing in this section shall be construed to invalidate or otherwise require repromulgation of any existing rules promulgated by the board of health and welfare. All existing rules promulgated by the board of health and welfare shall continue in full force and effect as if adopted by the department and shall remain in effect until amended or repealed by the department, rejected by the legislature, or otherwise changed pursuant to law.
