  1                                        AN ACT
  2    RELATING TO INSURANCE; AMENDING SECTION 41-226, IDAHO CODE,  TO  PROVIDE  LAN-
  3        GUAGE  TO CLARIFY THAT EXAMINERS WHO ARE EMPLOYEES OF THE DEPARTMENT SHALL
  4        BE NONCLASSIFIED EMPLOYEES.
                                                                        
  5    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
  6        SECTION 1.  That Section 41-226, Idaho Code, be, and the  same  is  hereby
  7    amended to read as follows:
                                                                        
  8        41-226.  EXAMINERS  -- QUALIFICATIONS. For the conduct of or assistance in
  9    examinations under this chapter the director shall appoint as  examiners  only
 10    individuals  who  by  reason of education, experience, or special training are
 11    competent to perform the duties and fulfill the responsibilities of an  insur-
 12    ance  examiner. In the selection of examiners the director shall give due con-
 13    sideration  to  standards  and  qualifications  therefor  recommended  by  the
 14    National Association of Insurance Commissioners or any successor  organization
 15    thereto.  The director may appoint, employ, fix the compensation of, prescribe
 16    and require the duties of and discharge such examiners as the  duties  of  his
 17    office  may  require.  Examiners  who are employees of the department shall be
 18    nonclassified employees exempt from the provisions of chapter  53,  title  67,
 19    Idaho Code.

This bill clarifies language so as to acknowledge that some of the
examiners the department uses are contractors, while others are
actual employees of the department.

     





                         FISCAL IMPACT
There is no fiscal impact to the state's General Fund.
