|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 157 BY AGRICULTURAL AFFAIRS COMMITTEE 1 AN ACT 2 RELATING TO IDAHO AGRICULTURAL LABOR LAW; REPEALING CHAPTER 41, TITLE 22, 3 IDAHO CODE, RELATING TO THE IDAHO AGRICULTURAL LABOR ACT. 4 Be It Enacted by the Legislature of the State of Idaho: 5 SECTION 1. That Chapter 41, Title 22, Idaho Code, be, and the same is 6 hereby repealed.
STATEMENT OF PURPOSE RS 12760 This bill repeals the Idaho Agricultural Labor Act that was enacted in 1972 because there has never been a request for action under the Act. The Act defines unfair labor practices for employers and workers in agricultural labor and creates the Agricultural Labor Board to hold hearings on charges of unfair labor practices under the Act. The Board is also required to hold hearings on proposed collective bargaining units and has authority to conduct elections to determine labor representation. Since its creation over twenty-five years ago, the Agricultural Labor Board has never received a petition or a complaint and, consequently, has never held a hearing. The Board has met a total of five times: three times in December 1974; twice in 1976; and once in 1977. At the 1977 meeting, the Board agreed not to meet unless there was business to discuss and there has never been another meeting. Because the Act has never been utilized and more recent state and federal laws address agricultural labor concerns, it is in the best interest of the State of Idaho to repeal the Act and eliminate a Board that is not necessary. FISCAL IMPACT There is no impact on the State General Fund. However, past funding for the Agricultural Labor Board came from the State General Fund. If the Act is not repealed and future complaints are filed under the Act, funding would be necessary.
