|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE HOUSE OF REPRESENTATIVES HOUSE BILL NO. 368 BY WAYS AND MEANS COMMITTEE 1 AN ACT 2 RELATING TO IMMUNIZATION REQUIREMENTS; AMENDING SECTION 39-4804, IDAHO CODE, 3 TO REQUIRE NOTIFICATION OF A VACCINE RECIPIENT, TO PROHIBIT DENIAL OF 4 ADMISSION OR SERVICES BASED UPON FAILURE TO BE IMMUNIZED. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. That Section 39-4804, Idaho Code, be, and the same is hereby 7 amended to read as follows: 8 39-4804. NOTIFICATION TO PARENT,ORGUARDIAN, OR ADULT VACCINE RECIPIENT. 9 Before an immunization is administered to anychildperson in this state, the 10 adult or the parent or guardian of the child shall be notified that: 11 (1) Immunizations are not mandatory and may be refused on religious or 12 other grounds; 13 (2) Participation in the immunization registry is voluntary; 14 (3) The vaccine recipient or the parent or guardian is entitled to an 15 accurate explanation of the complications known to follow such immunization. 16 The department of health and welfare, by rule, shall create and publish a dis- 17 closure form for each vaccine administered, which shall include all risks, 18 contraindications, warnings, and adverse reactions as listed in the 19 manufacturer's package insert, and the benefits of each vaccine. 20 (4) No school, medical establishment, or other facility shall deny admit- 21 tance or services to any person who is not fully immunized and who is lawfully 22 exempt from any immunization requirement. Any notice regarding immunization 23 disseminated by a school, medical, or other facility shall include the preced- 24 ing sentence, and an explanation of the legal right to refuse immunization 25 pursuant to section 39-4802(2), Idaho Code.
STATEMENT OF PURPOSE RS 13110C3 The purpose of this legislation is to amend the section of Idaho Code that relates to immunizations, to clarify existing state law, to require notification that immunization is voluntary, and to prohibit denial of services.
