|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1024 BY FINANCE COMMITTEE 1 AN ACT 2 APPROPRIATING ADDITIONAL MONEYS TO THE DEPARTMENT OF AGRICULTURE FOR FISCAL 3 YEAR 2003; REDUCING THE GENERAL FUND APPROPRIATION TO THE DEPARTMENT OF 4 AGRICULTURE FOR FISCAL YEAR 2003; AND DECLARING AN EMERGENCY. 5 Be It Enacted by the Legislature of the State of Idaho: 6 SECTION 1. In addition to the appropriation made in Section 1, Chapter 7 270, Laws of 2002, there is hereby appropriated to the Department of Agricul- 8 ture the following amount to be expended for the designated program according 9 to the designated expense class from the listed fund for the period July 1, 10 2002, through June 30, 2003: 11 ANIMAL DAMAGE CONTROL: 12 FOR: 13 Trustee and Benefit Payments $40,000 14 FROM: 15 Agricultural Fees - Sheep Industry Regulation Fund $40,000 16 SECTION 2. Notwithstanding any other provision of law to the contrary, 17 the appropriation of moneys made in Section 1, Chapter 270, Laws of 2002, is 18 hereby reduced by the following amount from the designated program according 19 to the designated expense class from the listed fund for the period July 1, 20 2002, through June 30, 2003: 21 ANIMAL DAMAGE CONTROL: 22 FOR: 23 Trustee and Benefit Payments $34,900 24 FROM: 25 General Fund $34,900 26 SECTION 3. An emergency existing therefor, which emergency is hereby 27 declared to exist, this act shall be in full force and effect on and after its 28 passage and approval.

One-time spending authority is shifted from the General Fund to dedicated funds to provide support to animal damage control districts. This legislation would spend down a cash balance in the Sheep Regulation Fund generated from two sources. First, revenues come from a 3 cent per pound of wool fee charged to wool growers for animal damage control. (Prior to July 1, 2002, .25 cents was remitted for scrappie indemnity). Second, the brand inspector collects revenues on cattle, horses, mules, and dairy cows subject to brand inspection and remits 4 cents per head to the Idaho State Department of Agriculture for animal damage control. The monies are passed through to the animal damage control board for distribution to the federal Wildlife Services for programs including magpie and starling control and predator control.

This supplemental appropriation increases spending authority in dedicated funds by $40,000 and reduces the General fund appropriation for animal damage control by $34,900 for a total of $5,100. This bill will increase the appropriation from these dedicated fees from $144,300 to $184,300 on a one-time basis for fiscal year 2003 and decrease the General Fund support from $148,100 to $113,200 on a one-time basis. The remaining $5,100 in dedicated spending authority is included to offset the 3.5% General Fund holdback in place for the current year.
