|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1042 BY TRANSPORTATION COMMITTEE 1 AN ACT 2 RELATING TO DEALER AND MANUFACTURER LICENSE PLATES; AMENDING SECTION 49-411, 3 IDAHO CODE, TO LIMIT THE NUMBER OF LICENSE PLATES THAT A DEALER MAY BE 4 ISSUED BASED ON THE NUMBER OF VEHICLES SOLD DURING THE PREVIOUS DEALER 5 LICENSING PERIOD AND TO AUTHORIZE THE DEPARTMENT TO AUDIT VEHICLE SALES 6 DURING PREVIOUS YEARS BEFORE RENEWAL OF A DEALER'S LICENSE. 7 Be It Enacted by the Legislature of the State of Idaho: 8 SECTION 1. That Section 49-411, Idaho Code, be, and the same is hereby 9 amended to read as follows: 10 49-411. DEALER AND MANUFACTURER PLATE -- FEES. (1) Any person conducting 11 the business of manufacturing, buying, selling or dealing in vehicles, and 12 licensed as a manufacturer of or a dealer in vehicles, and owning and operat- 13 ing any such vehicle upon any highway may, in lieu of registering each vehicle 14 obtain from the department upon application on the proper form and payment of 15 the required fee, and attach to each vehicle, one (1) number plate as required 16 for different classes of vehicles in section 49-434, Idaho Code. The special 17 number plate shall bear a distinctive number assigned to the manufacturer or 18 dealer, the name of this state, which may be abbreviated, and the year for 19 which the plate is issued, together with words which may be abbreviated or a 20 distinguishing symbol indicating that the plate is issued to a manufacturer or 21 dealer. 22 (a) Dealer license plates shall be limited to two (2) license plates for 23 up to twenty (20) vehicles sold during the previous dealer licensing 24 period and one (1) license plate for each ten (10) additional vehicles 25 sold during the previous dealer licensing period. Any new dealer who 26 applies for a dealer license shall be eligible for the number of dealer 27 plates requested based on the number of vehicles that the dealer estimates 28 he will sell during the first year of licensure. 29 (b) Upon renewal of a dealer's license, the department may audit vehicle 30 sales from previous years to determine the number of dealer plates that 31 will be authorized for the current dealer licensing period. 32 (2) The fee to validate a dealer or manufacturer number plate shall be 33 twelve dollars ($12.00) for each validation sticker. 34 (3) All such fees shall be paid to the state treasurer and deposited to 35 the state highway account.
STATEMENT OF PURPOSE RS 12667 The purpose of this legislation is to limit the number of dealer plates that a dealer may request to two (2) dealer plates for the first twenty (20) vehicles sold during the previous dealer licensing period and one (1) additional dealer plate for each ten (10) additional vehicles sold during the previous dealer licensing period. This change will reduce the problem of unauthorized use of dealer plates across the state. Many dealers purchase dealer plates that are well above any legal usage of the plates that the dealer might have. This legislation will also reduce the illegal usage of dealer plates by salesmen working under a dealer's license, keeping his own books and acting as a licensed dealer. This legislation will also keep dealers from using plates on vehicles that are being used by other unauthorized persons known to the dealer. FISCAL IMPACT None.
