|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE BILL NO. 1057 BY RESOURCES AND ENVIRONMENT COMMITTEE 1 AN ACT 2 RELATING TO THE IDAHO GEOLOGICAL SURVEY; AMENDING SECTION 47-201, IDAHO CODE, 3 TO STRIKE THE TRANSFER OF RESPONSIBILITY FROM THE BUREAU OF MINES AND 4 GEOLOGY TO THE GEOLOGICAL SURVEY, TO DELETE THE REQUIREMENT THAT THE DEAN 5 OF THE COLLEGE OF MINES AND EARTH RESOURCES OF THE UNIVERSITY OF IDAHO BE 6 DIRECTOR OF THE GEOLOGICAL SURVEY AND THE BOARD CHAIRPERSON AND TO PROVIDE 7 THAT THE CHAIRMAN OF THE DEPARTMENT OF GEOLOGICAL SCIENCES AT THE UNIVER- 8 SITY OF IDAHO SHALL SERVE AND BE COMPENSATED AS A MEMBER OF THE GEOLOGICAL 9 SURVEY ADVISORY BOARD; AMENDING SECTION 47-202, IDAHO CODE, TO DELETE THE 10 SPECIFIED DATE FOR THE ANNUAL MEETING OF THE ADVISORY BOARD, TO DELETE THE 11 REQUIREMENT THAT THE OFFICE OF THE SURVEY'S SECRETARY BE MAINTAINED AT THE 12 UNIVERSITY OF IDAHO, TO PROVIDE THAT THE DIRECTOR OF THE SURVEY SHALL 13 REPORT TO AND BE APPOINTED BY THE VICE PRESIDENT FOR RESEARCH AT THE UNI- 14 VERSITY OF IDAHO AND TO STRIKE UNNECESSARY VERBIAGE; AND AMENDING SECTION 15 47-203, IDAHO CODE, TO PROVIDE FOR THE PREPARATION AND PUBLICATION OF 16 REPORTS ON HYDROGEOLOGY AND GEOLOGIC HAZARDS AND TO DELETE THE REQUIREMENT 17 THAT THE STATE SURVEY MAINTAIN LABORATORY FACILITIES TO PERFORM NONCOMMER- 18 CIAL MINERAL AND CHEMICAL ANALYSES. 19 Be It Enacted by the Legislature of the State of Idaho: 20 SECTION 1. That Section 47-201, Idaho Code, be, and the same is hereby 21 amended to read as follows: 22 47-201. GEOLOGICAL SURVEY CREATED -- PURPOSE -- ADVISORY BOARD. There is 23 hereby created the Idaho geological survey, to be administered as a special 24 program at the university of Idaho under the authority of the board of regents 25 of the university of Idaho.This survey will conduct business heretofore car-26ried out by the Idaho bureau of mines and geology.The survey shall be the 27 lead state agency for the collection, interpretation, and dissemination of 28 geologic and mineral data for Idaho. Such information is to be acquired 29 through field and laboratory investigations by the staff of the survey and 30 through cooperative programs with other governmental and private agencies. 31 There is hereby established an advisory board for the survey, consisting of 32 the following members: Thedean of the college of mines and earth resources of33the university of Idaho, who shall bedirector of the survey and board chair- 34 person (nonvoting); the chairman of the department of geology at Boise state 35 university; the chairman of the department of geology at Idaho state univer- 36 sity; the chairman of the department of geological sciences at the university 37 of Idaho; the president of the Idaho mining association, so long as said asso- 38 ciation continues to exist and elect a president; the governor of the state of 39 Idaho or his designated representative; a member of the board of land commis- 40 sioners designated by the state land board; the president or his designee of 41 the Idaho association of professional geologists; and two (2) members at large 42 selected by the director from other state or federal organizations, or from 43 the private sector with a direct interest in the survey's programs, both serv- 2 1 ing two (2) year staggered terms; all of whom shall serve as members of the 2 said board and shall be compensated as provided by section 59-509(b), Idaho 3 Code. 4 SECTION 2. That Section 47-202, Idaho Code, be, and the same is hereby 5 amended to read as follows: 6 47-202. MEETINGS -- OFFICE -- STATE GEOLOGIST. The advisory board shall 7 hold an annual meetingsat the university of Idaho, Boise state university or 8 Idaho state universityon the first Monday of June of each yearand such other 9 meetings as it may determine. The chief office of said surveyand the office10of its secretaryshall be maintained at the university of Idaho. The director 11 of the survey shall report to and be appointed by the vice president for 12 research at the university of Idaho. The director,of the survey,or a profes- 13 sional geologist in the survey if so appointed by the director, is designated 14 state geologist. 15 SECTION 3. That Section 47-203, Idaho Code, be, and the same is hereby 16 amended to read as follows: 17 47-203. DUTIES -- PUBLICATIONS -- COOPERATION WITH OTHER AGENCIES -- 18 SATELLITE OFFICES. It shall be the duty of the said state survey to conduct 19 statewide studies in the field; laboratory studies; prepare and publish 20 reports on the geology, hydrogeology, geologic hazards and mineral resources 21 of the state;maintain laboratory facilities to perform noncommercial mineral22and chemical analyses;fix a price upon printed reports not used in exchange 23 with other state bureaus or surveys, universities or public libraries, and 24 deposit receipts from sales in a printing fund to be used for the preparation 25 and publication of reports of the survey, and for no other purpose. The survey 26 shall be allowed to seek and accept funded projects from and cooperative pro- 27 grams with other agencies for support of the survey's research and service 28 activities as authorized by the board of regents. All funds received from 29 these projects shall be used for said projects and services. The survey shall 30 be allowed to have satellite offices at the geology departments of Boise state 31 university and Idaho state university.
STATEMENT OF PURPOSE RS 12441 This legislation provides for changes in the statute establishing the Idaho Geological Survey. These changes reflect organizational changes that have taken place at the University of Idaho during 2002. FISCAL IMPACT There is no fiscal impact.
