GEOLOGICAL SURVEY - Amends existing law to delete the requirement that the
dean of the College of Mines and Earth Resources of the University of Idaho be
director of the Geological Survey and board chairperson; to revise membership
of the advisory board for the Geological Survey; to delete the specified date
for the  annual meetings; to delete the requirement that the secretary's
office be maintained at the University of Idaho; to provide that the director
of the Geological Survey shall report to the President of the University of
Idaho through the Vice President for Research at the University of Idaho; to
provide for preparation and publication of reports on hydrogeology and
geologic hazards; and to delete the requirement that the state survey maintain
laboratory facilities to perform noncommercial mineral and chemical analyses.

  1                                        AN ACT
  2    RELATING TO THE IDAHO GEOLOGICAL SURVEY; AMENDING SECTION 47-201, IDAHO  CODE,
  3        TO  STRIKE  THE  TRANSFER  OF  RESPONSIBILITY FROM THE BUREAU OF MINES AND
  4        GEOLOGY TO THE GEOLOGICAL SURVEY, TO DELETE THE REQUIREMENT THAT THE  DEAN
  5        OF  THE COLLEGE OF MINES AND EARTH RESOURCES OF THE UNIVERSITY OF IDAHO BE
  6        DIRECTOR OF THE GEOLOGICAL SURVEY AND THE BOARD CHAIRPERSON AND TO  REVISE
  7        MEMBERSHIP  ON THE GEOLOGICAL SURVEY; AMENDING SECTION 47-202, IDAHO CODE,
  8        TO DELETE THE SPECIFIED DATE FOR THE ANNUAL MEETING OF THE ADVISORY BOARD,
  9        TO DELETE THE REQUIREMENT THAT THE OFFICE OF  THE  SURVEY'S  SECRETARY  BE
 10        MAINTAINED AT THE UNIVERSITY OF IDAHO, TO PROVIDE THAT THE DIRECTOR OF THE
 11        SURVEY  SHALL  REPORT TO THE PRESIDENT OF THE  UNIVERSITY OF IDAHO THROUGH
 12        THE VICE PRESIDENT FOR RESEARCH AT THE UNIVERSITY OF IDAHO AND  TO  STRIKE
 13        UNNECESSARY  VERBIAGE; AND AMENDING SECTION 47-203, IDAHO CODE, TO PROVIDE
 14        FOR THE PREPARATION AND PUBLICATION OF REPORTS ON  HYDROGEOLOGY  AND  GEO-
 15        LOGIC HAZARDS AND TO DELETE THE REQUIREMENT THAT THE STATE SURVEY MAINTAIN
 16        LABORATORY FACILITIES TO PERFORM NONCOMMERCIAL MINERAL AND CHEMICAL ANALY-
 17        SES.
                                                                        
 18    Be It Enacted by the Legislature of the State of Idaho:
                                                                        
 19        SECTION  1.  That  Section  47-201, Idaho Code, be, and the same is hereby
 20    amended to read as follows:
                                                                        
 21        47-201.  GEOLOGICAL SURVEY CREATED -- PURPOSE -- ADVISORY BOARD. There  is
 22    hereby  created  the  Idaho geological survey, to be administered as a special
 23    program at the university of Idaho under the authority of the board of regents
 24    of the university of Idaho. This survey will conduct business heretofore  car-
 25    ried  out  by  the  Idaho bureau of mines and geology. The survey shall be the
 26    lead state agency for the collection,  interpretation,  and  dissemination  of
 27    geologic  and  mineral  data  for  Idaho.  Such  information is to be acquired
 28    through field and laboratory investigations by the staff  of  the  survey  and
 29    through  cooperative  programs  with  other governmental and private agencies.
 30    There is hereby established an advisory board for the  survey,  consisting  of
 31    the following members: The dean of the college of mines and earth resources of
 32    the  university of Idaho, who shall be director of the survey and board chair-
 33    person (nonvoting); the chairman of the department of geology  geosciences  at
 34    Boise  state university; the chairman of the department of geology geosciences
 35    at Idaho state university; the president of the Idaho mining  association,  so
 36    long as said association continues to exist and elect a president chair of the
 37    department of geological sciences at the university of Idaho; a representative
 38    from  the mining and mineral processing industry selected by the director; the
 39    governor of the state of Idaho or his designated representative; a  member  of
 40    the board of land commissioners designated by the state land board; the presi-
 41    dent  or his designee of the Idaho association of professional geologists; and
 42    two (2) members at large selected by the director from other state or  federal
 43    organizations,  or  from  the  private  sector  with  a direct interest in the

  1    survey's programs, both serving two (2) year  staggered  terms;  all  of  whom
  2    shall  serve as members of the said board and shall be compensated as provided
  3    by section 59-509(b), Idaho Code.
                                                                        
  4        SECTION 2.  That Section 47-202, Idaho Code, be, and the  same  is  hereby
  5    amended to read as follows:
                                                                        
  6        47-202.  MEETINGS  --  OFFICE -- STATE GEOLOGIST. The advisory board shall
  7    hold an annual meetings at the university of Idaho, Boise state university  or
  8    Idaho state university on the first Monday of June of each year and such other
  9    meetings  as  it may determine. The chief office of said survey and the office
 10    of its secretary shall be maintained at the university of Idaho. The  director
 11    of  the  survey  shall  report  to  the   president of the university of Idaho
 12    through the vice president for research at the university of Idaho. The direc-
 13    tor, of the survey, or a professional geologist in the survey if so  appointed
 14    by the director, is designated state geologist.
                                                                        
 15        SECTION  3.  That  Section  47-203, Idaho Code, be, and the same is hereby
 16    amended to read as follows:
                                                                        
 17        47-203.  DUTIES -- PUBLICATIONS -- COOPERATION  WITH  OTHER  AGENCIES   --
 18    SATELLITE  OFFICES.  It  shall be the duty of the said state survey to conduct
 19    statewide studies in  the  field;  laboratory  studies;  prepare  and  publish
 20    reports  on  the geology, hydrogeology, geologic hazards and mineral resources
 21    of the state; maintain laboratory facilities to perform noncommercial  mineral
 22    and  chemical  analyses; fix a price upon printed reports not used in exchange
 23    with other state bureaus or surveys, universities  or  public  libraries,  and
 24    deposit  receipts from sales in a printing fund to be used for the preparation
 25    and publication of reports of the survey, and for no other purpose. The survey
 26    shall be allowed to seek and accept funded projects from and cooperative  pro-
 27    grams  with  other  agencies  for support of the survey's research and service
 28    activities as authorized by the board of  regents.  All  funds  received  from
 29    these  projects shall be used for said projects and services. The survey shall
 30    be allowed to have satellite offices at the geology departments of Boise state
 31    university and Idaho state university.

the Idaho Geological Survey. These changes reflect organizational
changes that have taken place at the University of Idaho during 2002.
