|||| LEGISLATURE OF THE STATE OF IDAHO |||| Fifty-seventh Legislature First Regular Session - 2003IN THE SENATE SENATE CONCURRENT RESOLUTION NO. 115 BY STATE AFFAIRS COMMITTEE 1 A CONCURRENT RESOLUTION 2 STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO 3 APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE STATUTES GOV- 4 ERNING CHARTER SCHOOLS. 5 Be It Resolved by the Legislature of the State of Idaho: 6 WHEREAS, in 1998, the Idaho Legislature authorized that charter schools 7 could be organized and operated under the law of Idaho; and 8 WHEREAS, it was recognized at the time that the concept of charter schools 9 would be experimental in nature, and the Legislature anticipated continuing 10 oversight of the charter school provisions; and 11 WHEREAS, in the intervening years since the original enactment, several 12 changes have been made in laws governing charter schools; and 13 WHEREAS, during the First Regular Session of the Fifty-seventh Idaho Leg- 14 islature, additional requests have come forth to further clarify, monitor and 15 circumscribe provisions governing creation, management and operation of 16 charter schools; and 17 WHEREAS, it is incumbent upon the Legislature to assure that educational 18 institutions operate in the best interests of the children of the state of 19 Idaho. 20 NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session 21 of the Fifty-seventh Idaho Legislature, the Senate and the House of Represen- 22 tatives concurring therein, that the Legislative Council is authorized to 23 appoint a committee to undertake and complete a study of the statutes govern- 24 ing charter schools in Idaho. The Legislative Council shall determine the num- 25 ber of legislators and membership from each house appointed to the committee 26 and shall authorize the committee to receive input, advice and assistance from 27 interested and affected parties who are not members of the Legislature. 28 BE IT FURTHER RESOLVED that nonlegislative members of the committee may be 29 appointed by the cochairs of the committee who are appointed by the Legisla- 30 tive Council. Nonlegislative members of the advisory committee shall not be 31 reimbursed from legislative funds for per diem, mileage or other expenses and 32 shall not have voting privileges regarding the committee's recommendations or 33 proposed legislation. 34 BE IT FURTHER RESOLVED that the committee shall report its findings, rec- 35 ommendations and proposed legislation, if any, to the Second Regular Session 36 of the Fifty-seventh Idaho Legislature.
STATEMENT OF PURPOSE RS 13123 This proposal will direct the legislature to establish a study committee to undertake and complete a study of the statutes governing charter schools. FISCAL IMPACT If this resolution is adopted by the Legislature and the committee is appointed, any necessary travel and per diem expense would be paid from the existing legislative appropriation to the Senate and the House of Representatives. Funding for staff support and expenses would be provided from the existing appropriation to the Legislative Council for the Legislative Services Office.
