2 RELATING TO MILITARY PERSONNEL; AMENDING THE HEADING FOR CHAPTER 2, TITLE 46,
3 IDAHO CODE, TO REFER TO PERSONNEL; AMENDING SECTION 46-216, IDAHO CODE, TO
4 INCLUDE EMPLOYEES OF PUBLIC SCHOOL DISTRICTS IN THE JOB PROTECTION GUARAN-
5 TEES OF STATE EMPLOYEES DURING TIME OF ACTIVE MILITARY SERVICE; AND
6 DECLARING AN EMERGENCY.
7 Be It Enacted by the Legislature of the State of Idaho:
8 SECTION 1. That the heading for Chapter 2, Title 46, Idaho Code, be, and
9 the same is hereby amended to read as follows:

11 OFFICERS AND ENLISTED MEN PERSONNEL
12 SECTION 2. That Section 46-216, Idaho Code, be, and the same is hereby
13 amended to read as follows:
14 46-216. LEAVE OF ABSENCE FROM REGULAR DUTIES FOR FIELD TRAINING -- EXCEP-
15 TIONS. All officers and employees of the state of Idaho, including public
16 school district employees, who shall be members of the national guard or who
17 shall be reservists in the armed forces of the United States, shall be enti-
18 tled to leave of absence from their respective duties without loss of pay,
19 time, or efficiency rating on all days during which they shall be engaged in
20 field training ordered or authorized under the provisions of the national
21 defense act; provided that this shall not apply to any period of time spent in
22 active service of the United States, except that a period of fifteen (15) days
23 or less in reserve training in any one (1) calendar year shall not be consid-
24 ered time spent in active service of the United States, for the purposes of
25 this act.
26 SECTION 3. An emergency existing therefor, which emergency is hereby
27 declared to exist, this act shall be in full force and effect on and after its
28 passage and approval.
STATEMENT OF PURPOSE
RS 12829
The purpose of this legislation is to amend Idaho Cod 46-216
providing employees of an Idaho public school district with the
same rights as the state of Idaho provides state employees who
serve in the National Guard or as a reservist in the armed forces
of the United States. This legislation entitles public school
employees to a leave of absence to serve up to 15 days of reserve
training, ordered or authorized under the provisions of the
national defense act, without loss of pay, time, or efficiency
rating.
FISCAL IMPACT
There is no fiscal impact on the General Fund. There may be a
fiscal impact to Idaho school districts that have reduced or
withheld compensation for employees who serve up to 15 days of
reservist training.
