                                 BY STATE AFFAIRS COMMITTEE
                                                                        
  1                                   A JOINT MEMORIAL
  2    TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE UNITED  STATES  IN  CONGRESS
  3        ASSEMBLED,  AND  TO THE CONGRESSIONAL DELEGATION REPRESENTING THE STATE OF
  4        IDAHO IN THE CONGRESS OF THE UNITED STATES.
                                                                        
  5        We, your Memorialists, the House of Representatives and the Senate of  the
  6    State  of  Idaho  assembled  in the First Regular Session of the Fifty-seventh
  7    Idaho Legislature, do hereby respectfully represent that:
                                                                        
  8        WHEREAS, the Constitution of the United States  establishes  a  republican
  9    form of government; and
 10        WHEREAS,  through  many years of history, state legislatures followed this
 11    pattern established in the Congress of the United States; and
 12        WHEREAS, decisions of the Supreme Court of the United States have mandated
 13    a contradictory form to be applied to the Senate and House of  Representatives
 14    of the states; and
 15        WHEREAS,  we  find  that the states would be better served by adherence to
 16    the original intent of the founders; and
 17        WHEREAS, it will be necessary to submit an amendment to  the  Constitution
 18    of  the United States to reestablish the original republican form in the state
 19    legislatures.
 20        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 21    of the Fifty-seventh Idaho Legislature, the House of Representatives  and  the
 22    Senate  concurring  therein, that we urge the Congress of the United States to
 23    adopt and submit to the states an amendment to reestablish the  right  of  the
 24    states  to follow the districting pattern of the Congress of the United States
 25    with the Senate by county and the House of Representatives by population.
 26        BE IT FURTHER RESOLVED that the Chief Clerk of the  House  of  Representa-
 27    tives  be, and she is hereby authorized and directed to forward a copy of this
 28    Memorial to the President of the Senate and the Speaker of the House of Repre-
 29    sentatives of Congress, and  the  congressional  delegation  representing  the
 30    State of Idaho in the Congress of the United States.

                       STATEMENT OF PURPOSE

The purpose of this legislation is to call for an amendment to
the United States Constitution affirming the right of the states
to reestablish the original republican form of government in the
state legislatures.
