  1                               A CONCURRENT RESOLUTION
  2    STATING FINDINGS OF THE LEGISLATURE AND AUTHORIZING THE LEGISLATIVE COUNCIL TO
  3        APPOINT A COMMITTEE TO UNDERTAKE AND COMPLETE A STUDY OF THE  LOCAL  PLAN-
  4        NING ACT AND RELATED STATUTES.
                                                                        
  5    Be It Resolved by the Legislature of the State of Idaho:
                                                                        
  6        WHEREAS,  the  Local Planning Act contained in Chapter 65, Title 67, Idaho
  7    Code, was enacted in 1975 and contains  a  lengthy  statement  of  legislative
  8    intent set forth in Section 67-6502, Idaho Code, for the Act's purpose; and
  9        WHEREAS,  the Local Planning Act has served Idaho's citizens well over the
 10    years while Idaho's population  has grown rapidly and demands for governmental
 11    services have expanded exponentially; and
 12        WHEREAS, other provisions of law including the three percent property  tax
 13    cap for local governments  contained in Section 63-802, Idaho Code, and devel-
 14    opment impact fees contained in Chapter 82, Title 67, Idaho Code, have impacts
 15    on  the  planning process and the providing of essential services to citizens;
 16    and
 17        WHEREAS, because of the changes in demographics and population  in  Idaho,
 18    it  is  time to review the Local Planning Act and related laws to ensure their
 19    modernity, to ensure that the purpose  mentioned  in  Section  67-6502,  Idaho
 20    Code,  is  being achieved and to reflect relevance to today's Idaho population
 21    for infrastructure needs, natural resource protection, and for economic growth
 22    opportunities.
 23        NOW, THEREFORE, BE IT RESOLVED by the members of the First Regular Session
 24    of the Fifty-seventh Idaho Legislature, the Senate and the House of  Represen-
 25    tatives  concurring  therein,  that  the  Legislative Council is authorized to
 26    appoint a committee to undertake and complete a study of  the  Local  Planning
 27    Act  and  related  laws  and suggest any modernization of the laws that may be
 28    needed. The Legislative Council shall determine the number of legislators  and
 29    membership  from each house appointed to the committee and shall authorize the
 30    committee to receive input, advice and assistance from interested and affected
 31    parties who are not members of the Legislature.
 32        BE IT FURTHER RESOLVED that nonlegislative members of the committee may be
 33    appointed by the cochairs of the committee who are appointed by  the  Legisla-
 34    tive  Council.  Nonlegislative  members of the advisory committee shall not be
 35    reimbursed from legislative funds for per diem, mileage or other expenses  and
 36    shall  not have voting privileges regarding the committee's recommendations or
 37    proposed legislation.
 38        BE IT FURTHER RESOLVED that the committee shall report its findings,  rec-
 39    ommendations  and  proposed legislation, if any, to the Second Regular Session
 40    of the Fifty-seventh Idaho Legislature.

Statement of Purpose / Fiscal Impact



                       STATEMENT OF PURPOSE
                             RS 12938
     This resolution authorizes the Legislative Council to
appoint an interim study committee to undertake a review of the
Local Planning Act.
     Many changes have occurred in Idaho since passage of the act
and there appear to be increasing land use-related conflicts.  It
is timely to undertake such a review to determine if changes need
to be made to assist local governments in their difficult
decisions.
                          FISCAL IMPACT
     Any necessary costs associated with the committee would be
paid out of existing appropriations for the Legislative Council
for the Legislative Services Office.
